dear friends,
in the last months i have done some deals and really like to enter this awesome industry.
Unfortunately, i came across an interesting and worrying phenomenon.
95% of the people are honest and very kind .
There is a serious problem. There are five percent of the people who steal, cheat and lie.
The decent people are losing lots of money and afraid to do some deals. some use escrow , some not.
I set up a project to protect or giving more protect and defence to do deals with confidence.
i think to create General agreement,Legal contract .
this contract will give us more protect and even important forensic evidence which you can use to show paypal or any other payment system if you want a refund.
how is going to work?
i will set up a site with custom contract . you will choose the parameters.
for example for small deal the contract will be very simple, client A agree to pay... for xxx.com x hours. details of client A .. and an electronic signature.
you can choose which details you want from your client or seller . how deep the contract will be ..
i hope you understand me and getting my mind.this is very small summary.
this can be a great and important tool to give our industry more protection and more professional image.
i want to hear from you, what do you think about it? its very important .

This is a good idea but I think it can also be achieved with the Paypal invoicing system...

Basically, what I normally do is send the buyer a Paypal generated invoice... in the section at the bottom, I add all the details of the transaction. Like domain name in question and registrar and that domain will be transferred from Account username: to Account Username: and that the buyer accepts that once the transfer has been initiated then NO refunds will be permitted.

Contract won't really save you when the other person lives halfway around the world. Unless you want to spend money to chase them.

Yeah totally agree...but I think he means mainly to use for Paypal disputes and stuff like that...not to actually pursue the matter legally.

Ah. well honestly using an escrow service is best. or maybe make them pay via friends and family option only.

i know that when the contract is worldwide is be very difficult to actually use it. but i try to think for more protection for us.

May help with Paypal to side with you if something goes wrong but there's always a risk.

What you really need is insurance imo... which probably only comes through an escrow provider.

Seriously, someone can buy a domain, get their money back by devious methods, then put your name in the WHOIS and say you got the domain back. Only a trusted intermdiary who actually at one point took ownership of the domain can ever hope to convince people that the buyer took control of the domain at some point.

You have options like Epik Escrow, Sedo Escrow, etc. Those are safe and IMO worth the 3% - 5% fees if you don't want to take chances with chargebacks or fraud.

great idea. I too wish to help develop something like this. Trust is very important in this business but due to some people , this business is getting the bad name. Escrow is good but something more sophisticated should be developed.

It still doesn't protect you from a charge back.

With Pay/Pal the customer almost always wins, even if they are wrong, or are only out to cheat you.

I have a customer now for a very small transaction that is not worth using escrow.

Haven't used Pay/Pal for an end user domain transaction in years because of past problems with them.

I am on the fence about trusting them again after all this time.

This transaction is not a lot of money, but a charge back can mess up your Pay/Pal account, bank accounting and other stuff, and is just a plain pain in the a**!!

I am thinking of not doing the sale at all.

That is how much I hate dealing with Pay/Pal's BS!!

I totally agree that they tend to favour the buyer more than the seller...however, I have always been able to argue my case properly and my account is about 9 years old now and I've probably had maybe 6 or 7 issues and I've never lost one yet. Basically the more info you can provide them to make your case stronger or to validate your side of the story the higher ur chances of winning the dispute. Using my disclaimer on the invoice is not at all a sure thing, but it does give you a bit more leverage to help argue your case with them.
