Hello,

I dont mean to sound like this is a big deal to you, but i have a record from today.

Around 6months ago this happened;

It was a very cold day, it was snowing and everyone was in a bad mood. I had an arguement with someone in the class, we will call him 'b'.

Once out of the class in the school grounds, i was walking (this was 2 months before i got my laptop) up to the school canteen.

B happy slapped me across the ear and it hurt, so around 10 seconds later with rage pushed him into the wall and b claims he hurt his hand so he pushed and i pushed back in more rage.

It ended with b walking away and i had to walk the other way with a bleeding nose and all i could remember after me pushing b into the wall was me being kneed in the face.

I reported it to the police one week after it happened, and now, 6months on as i forgot about it, it came back to haunt me with a call 2hrs ago saying i have an offical police warning.

My thoughts on the police before the inncodent were 'Oh great... Police, this is the biggest joke since a knock knock book'

After i reported i thought 'Wow, they are dealing with this well and they sortof treated me like a person and not a criminal.

Now i have the following problems;

1. I am obviously not going to get the job i desired (being a bobby).
2. I feel ill with worry and dont have a clue what to do if this happens again..
3. I am grounded for a month. It wasnt my fault. He started it.

I failed to mention that i have an anger management problem...

There is however one good thing.

Everyone at school expected me to come to school with the biggest black eye ever, i didnt even have a mark on me.

Now i get respected more and i have never been bullied since.

This is the last thing i will report to the police for a while. My confidence in the legal system has vanished totally.

Robert

Its only a police warning not an official record. When employers do a background check it wont come up.

Just dont be getting another one or it will become a record.

I cant see why you reported it to the plice, its a little playground fight and you were looking to get him into trouble by reporting to the police! And I'm sure it wont affect your chances of being a bobby!...just dont worry about it too much!

My mum is giving me the guilt trip again.

its a wind up... Forget about it...

How can you receive a warning from the police, when a, whats the crime you are being cautioned about...?? b, you havent admitted the offence and you need to have done to receive a caution..? c, If you are under 18 the 'warning' is called a 'reprimand'. If anyone mentioned the words 'warning' or 'caution' and you are under 18 then either they are a policeman who doesnt know basic UK criminal law or........ And d, none of this is ever done over the telephone...

And btw, all of the above has to be present in order for it to be legit...

A more serious crime however is representing a policeman...!

We know it was a police officer on the phone because they referred to the name of the person who interviewed me about it, and only the school and me (not even my mother knows who interviewed me).

It appears the decision was made today or sometime in the last 2 weeks. Our phone was off for 2 weeks, and there is currently a mail 'walkout' over pay in devon (http://news.bbc.co.uk/1/hi/england/devon/5311344.stm, striking is over according to todays news) so we havnt had any post since we have come back from holiday.

So have you admitted a crime? Are you over 18? Have you been cautioned about this alleged offence? Have you been questioned as a suspect about any alleged crime? Did they explain what the crime was? What evidence do they have against you?

if for any of the above you can answer NO or NONE then it is bogus, trust me...

If you dont believe me then check out the home office rules on police proceedure with regard "cautions" and / or "warnings"

Just one more question. If i decline the offense and say it is common assult, what grounds do i have for this and should i get a lawyer next time?
