Enom.com have opened queues for the .eu landrush. They have the Vip queue which cost $299.95 and the standard queue which costs $9.95. Enom says joining these queues gives you an advantage over other registrars.
I briefly looked at their agreement especially the section:
"In addition, in order to participate in the eNom .EU Pre-Registration Queues, you are required to submit to eNom within seventy-two (72) hours an original, executed Credit Card Authorization Agreement, unless you are a reseller customer and we are able to automatically debit your reseller account. If required, the Credit Card Authorization Agreement must be received by eNom within 72 hours (facsimile transmissions may be considered an original for these purposes) of entering any domain name in an eNom .EU Sunrise Queues. Failure to submit a timely Credit Card Authorization Agreement may result in eNom canceling your .EU Pre-Registration Queue submission(s). We may or may not provide you with notice that your .EU Pre-Registration Queue submission(s) has been canceled in the event that you fail to submit the Credit Card Authorization Agreement to us on time."
Nothing seemed out of the ordinary and I continued with my purchase. This agreement sounded like I would pay $9.95 to join the queue and then I would sign an agreement to alow them to charge $39.95 for my .eu name if they got it.
However, after I made my purchase of $9.95 to join the queue they sent me the following letter. They asked me to sign it and fax it to them within 72 hours. If I didn't I lose my $9.95 and my place in the queue.
"To: eNom Risk Management
Account Authorization Form
eNom Inc.
This letter is to authorize and guarantee eNom Inc. dba Domain Name Registration for any and all charges to my credit card, first 4 digits being _______________ and last 5 digits being ___________________, for purchases, fees, tariffs, taxes, or any other charges related to the .eu pre-registration queues, (collectively, the "Fees"). I understand that some of these Fees are non-refundable, regardless of whether the domains requested through the queue system are awarded to me or not. Additionally, I understand that should I be awarded the .eu domain names applied for, I will also be responsible for additional domain registration Fees and that these Fees may result in subsequent charges to the above credit card.
I understand in the event of a dispute processed by my credit card issuer, eNom Inc. will reserve the right to suspend access to any and all accounts I have, and that all rights, title, interest in, and use of any domain names and/or services connected shall be assumed by eNom Inc. at their discretion. I also understand that in the event of the aforementioned, I will be responsible for any and all transaction amounts and fees associated with the dispute, prior to any account reactivation, domain access, or domains awarded.
Please sign and fax to +001 425.974.4790 within 72 hours of your order to confirm entries. Be sure you have filled in the credit card number information requested in the first paragraph and that you have signed the authorization form below."
The second paragraph says I will be responsible for all costs of a dispute and these will be charged to my credit card. I am also signing to say enom can have the right to my domain name.
All I trying to do it pay $9.95 to go in the queue and if I win the name I expect to pay $39.95. By signing to this agreement I am giving enom permission to take upto $15,000 off my credit card (its limit) and to take my domain names.
This agreement that I have to sign from enom to continue in their queue for a $39.95 .eu name is totally unreasonable. No responsible business person or investor would sign such an agreement. If they did it could result in them losing their livelyhood and being made bankrupt.
Also, it is very suspicious they are giving a strict 72 deadline. If you buy a place in the queue on Friday evening the weekend is going to take 48 of those hours.
