Enom.com have opened queues for the .eu landrush. They have the Vip queue which cost $299.95 and the standard queue which costs $9.95. Enom says joining these queues gives you an advantage over other registrars.

I briefly looked at their agreement especially the section:

"In addition, in order to participate in the eNom .EU Pre-Registration Queues, you are required to submit to eNom within seventy-two (72) hours an original, executed Credit Card Authorization Agreement, unless you are a reseller customer and we are able to automatically debit your reseller account. If required, the Credit Card Authorization Agreement must be received by eNom within 72 hours (facsimile transmissions may be considered an original for these purposes) of entering any domain name in an eNom .EU Sunrise Queues. Failure to submit a timely Credit Card Authorization Agreement may result in eNom canceling your .EU Pre-Registration Queue submission(s). We may or may not provide you with notice that your .EU Pre-Registration Queue submission(s) has been canceled in the event that you fail to submit the Credit Card Authorization Agreement to us on time."

Nothing seemed out of the ordinary and I continued with my purchase. This agreement sounded like I would pay $9.95 to join the queue and then I would sign an agreement to alow them to charge $39.95 for my .eu name if they got it.

However, after I made my purchase of $9.95 to join the queue they sent me the following letter. They asked me to sign it and fax it to them within 72 hours. If I didn't I lose my $9.95 and my place in the queue.

"To: eNom Risk Management
Account Authorization Form
eNom Inc.

This letter is to authorize and guarantee eNom Inc. dba Domain Name Registration for any and all charges to my credit card, first 4 digits being _______________ and last 5 digits being ___________________, for purchases, fees, tariffs, taxes, or any other charges related to the .eu pre-registration queues, (collectively, the "Fees"). I understand that some of these Fees are non-refundable, regardless of whether the domains requested through the queue system are awarded to me or not. Additionally, I understand that should I be awarded the .eu domain names applied for, I will also be responsible for additional domain registration Fees and that these Fees may result in subsequent charges to the above credit card.

I understand in the event of a dispute processed by my credit card issuer, eNom Inc. will reserve the right to suspend access to any and all accounts I have, and that all rights, title, interest in, and use of any domain names and/or services connected shall be assumed by eNom Inc. at their discretion. I also understand that in the event of the aforementioned, I will be responsible for any and all transaction amounts and fees associated with the dispute, prior to any account reactivation, domain access, or domains awarded.

Please sign and fax to +001 425.974.4790 within 72 hours of your order to confirm entries. Be sure you have filled in the credit card number information requested in the first paragraph and that you have signed the authorization form below."

The second paragraph says I will be responsible for all costs of a dispute and these will be charged to my credit card. I am also signing to say enom can have the right to my domain name.

All I trying to do it pay $9.95 to go in the queue and if I win the name I expect to pay $39.95. By signing to this agreement I am giving enom permission to take upto $15,000 off my credit card (its limit) and to take my domain names.

This agreement that I have to sign from enom to continue in their queue for a $39.95 .eu name is totally unreasonable. No responsible business person or investor would sign such an agreement. If they did it could result in them losing their livelyhood and being made bankrupt.

Also, it is very suspicious they are giving a strict 72 deadline. If you buy a place in the queue on Friday evening the weekend is going to take 48 of those hours.

Nah enom won't do that and charge you ridiculously for $15000. Its just a legal document.

Agreed. Enom is only going to take what you are agreeing to pay. The $15k is just in there to protect themselves in case you buy a lot, they can receive payment.

Sometimes companies try to stipulate things like these just to save their back. But again they don't really put it into practice during peace time. Having said PEACE TIME, they will enforce it when they're having pain the bud.

I am pre-registering all my .eu domain names with NETWORKING4ALL.com who are based in Holland(so am I) They dont take any of my money or card details up front for the Landrush pre-registration I see immediately which position in their queue my name has. If my registration succeeds then and only then will they contact me for payment. That payment is a straight 9.50 euro per name for a year with no extra hidden costs. If I have a problem they are immediately available on the phone for help.
This is excellent service-The best

Laser: There is a 99.99% chance you will not get one for free.

And I think what they mean by 15,000 is maximum of 15,000. Like if have over 2000 domains, costing 16000, they could only charge your creditcard like 1500. But if you have like 10 names, they might just charge it like 80. :imho:

Maybe this should go into the legal section.

I'd love to see what Mr. Berryhill has to say.

What enom.com is doing is illegal so please be warned about this. Because of these practices they are implementing they are likely to be cancelled as a official registrar recognized by Eurid.

Beware of unauthorised pre-registrations
30 Jun 2005

Beware of .eu pre-registration sites from non-accredited registrars and of registrars "pooling" their pre-registrations with others to auction to the highest bidder those names where multiple applications are received.

We have been alerted to a number of companies who are not accredited .eu registrars are offering pre-registrations for the new .eu top level domain.

We would like to point out the European Commission, in its regulation 874/2004 has determined that only .eu pre-registrations taken after accreditation may be passed to the registry when registration begins. In addition, only accredited registrars will have access to the automated systems required to register a .eu name.

The Regulation 874/2004 also states that registrars must submit domain name registrations in the order in which they receive them. This requirement is also reflected in our registrar agreement to which all accredited registrars must sign up. However, it has come to our attention that some registrars are 'pooling' the pre-registrations they accept with those of their partner registrars with the intention of auctioning to the highest bidder the first place in the queue for that name. This is in clear breach of the EU regulation and the EURid registrar agreement. Those registrars who participate in such activities risk having their agreement terminated and so will be unable to submit the pre-registrations they have accepted.

We strongly recommend anyone who would like to register a .eu to contact an accredited .eu registrar from the growing list on our web site and to beware of schemes which invite them to participate in auctions.

To be found here: http://www.eurid.eu/en/general/news/beware-of-unauthorised-pre-registrations

They can not charge money to make special queue lines for extra paying customers as is written on the official eurid site.

Would you expect anything else unless the folks at enom were inept businessmen?

Ineptitude is not the issue ... cunning and exploitive practices are. Naive faith in registrar integrity should not be risked with registration fees or one's portfolio. This is an important lesson especially for new domainers. Online registrars (not all, but most) operate with very marginal business ethics. You might also need a frame of reference for understanding these comments.
