Need some advice here, Still new to all this and this is my first major"talk/negation".

So about a month ago I reg'd APOPS. org on the drop I liked it for several reasons.

Today I got a email from Jerold S. Kayden - simply saying -"Have you purchased the domain name apops.org?"....I looked at the Email name tag and it said, GSD Harvard . edu . Of course I was like Wow this is cool. Naturally I looked him up and Turns out he is Professor of Urban Planning and Design at Harvard University's Graduate School of Design. Also Founder of Advocates of Privately Owned Public Spaces....(apops)!!!! Wow again....turns out his other title is "Urban planner and LAWYER"!!:wideyed:.......How safe am I here????I did not look up Trademarks or anything like that on the name, could him being a Lawyer make this more difficult??

Please read this link here with The info on him and APOPS, he has a large team of pre$tigiou$ people and ceo's
https://apops.mas.org/about/people/

I have not responed to his email yet. I need suggestions , thoughts, opinions , appraisals, and maybe even legal advice ;)

Thank You

Robert

The views expressed on this page by users and staff are their own, not those of NamePros.
"Advocates for Privately Owned Public Space was founded by Harvard Professor Jerold S. Kayden in 2002 to invigorate and steward New York City’s 525 or so privately owned public spaces for the use and enjoyment of the city’s multiple publics. Shortly after its creation, APOPS joined forces with the Municipal Art Society of New York and the New York City Department of City Planning to work on issues of public space activation. APOPS hired a part-time senior public space specialist to help with monitoring and enforcement activities and proposed various ideas for activating POPS including an event entitled “The Red Chair Event.” In 2005, APOPS became a stand-alone New York State not-for-profit corporation. Soon thereafter, Kayden and APOPS collaborated with Lincoln Center for the Performing Arts and its president Reyn Levy in upgrading the under-performing Harmony Atrium indoor public space into what is now widely celebrated as the David Rubenstein Atrium designed by Billie Tsien and Tod Williams. APOPS and its chair, Jerold Kayden, have renewed their collaboration with the MAS through APOPS|MAS."

From the webpage, I think there is some money here ? Sounds like they have it

APOPS is a TM of ASSOCIATION FOR PELVIC ORGAN PROLAPSE SUPPORT

Sherrie Palm out of WI is the owner and it's for womens health. Jerold Kayden is not listed as the lawyer for this organization.Sounds like he may want it for his organization. Unless you hear from a Sherrie Palm and her representative, I wouldn't give up the domain too quick.
Disclaimer, I am not a TM lawyer, this is just my opinion!

Thanks Wesell..basically if I understand you correctly , he is NOT the person / Corporation Which would have a right to use the TM against me over the name...he may just have General interest in it for his apops organization, and not try to through the book at me over it? That alives me of some worry.

You are safe. There is nothing to worry. Infact even if he has the TM for APOPS, he should be chasing APOPS.COM owner and not you.
Also, going by the above response from WeSell, you can mention you are an member of ASSOCIATION FOR PELVIC ORGAN PROLAPSE SUPPORT. That way you have a reason to have the domain

How short would you keep it? Like just " yes I recently acquired it"..or more detail /filler as in explaining its for sale while I decided on developing it or not due to the fat I know of several potential interested parties??

Or is short and simple best here?

ok I went ahead and responded with this....

"
Hello Jerold,

Yes, I have recently acquired the name. Due to known interested and potentially interested parties, I have it listed for sale until I am able to develop it or approached by the right buyer. May I ask the reason for your inquiry?

Thank You,

Robert "

Why would you register that name in the first place??

That's where you could put a wrench in the system...

Because it's a good name, I generally try not to obtain poor ones.

So you registered the domain because of its liquid value?

I just find it confusing why it was regged.

While I respect both of your honest opinions. I've always been the out of the box thinker in anything I do in life, even with friends or family , some say it's the A-D-D........you all are more seasoned in domaining and I respect that, however ...it's not a case of what you "see" as it is what "I" see.

https://apops.mas.org/pops/559/..... Park Avenue is prime real-estate in NY.

Yes universities don't always have large budgets, good think this isn't run by the university.

apops is a separate Corporation started BY a University professor.

Regardless of this particular end-user, as i stated in my 2nd line at the beginning on the post, I liked it for several reasons. I see things many may not see and think things others may not. I respect your thoughts, however I posted this thread more so for the guidance through the negotiation process then, I did for votes on whether or not the name is good or bad.

Given that we are talking about an inbound inquiry over the name......

ps...MOD..my main objective was not the legal advice as it was , negotiation advice in general..If you see the thread movement fit, then I can't argue with that. I just wanted proper help in how to go about negotiating...yes there was a legal question involved, though not though not my main reasoning for posting.

Im questioning because Im gathering info before I give my advice.

I asked why you regged it because it looks like it was regged to squat on.

In the email you got I personally dont see an inquiry to purchase.

I see an inquiry on why did you reg the name.

He specifically states "did you reg this name"?

My guess is his next response will be "why did you reg this name"?

Following that will be a siest and desist letter due to possible infringement complications.

Remember, this guy is a lawyer.

Anyway, good luck.

I hope its a sale inquiry instead.

My 2 cents here.

his response

"Dear Mr. Gunther,

I inquired because I owned this domain name for over 10 years through July, 2017, and, through some glitch with the domain processor, they allowed it to be available. I am working through this with them at this very moment.

I am not a commercial entity. I am a professor at Harvard. In 2005, I created a small not for profit organization named Advocates for Privately Owned Public Space, thus APOPS.

As you may imagine, I am concerned about this. As a not for profit with virtually no assets, I am unable to recommend paying for the very domain name we have had for 10 years. If you are willing to part with it, however, for a payment that reflects your costs of acquisition, I would be thrilled to do so with great appreciation. It is important to me, as you may imagine.

For the website of APOPS, please take a look:

apops.mas.org,

Thanks for responding so quickly.

Sincerely, Jerold Kayden"

Little annoyed he played the poor card , and there was no glitch , he let it expire .

It's your domain now.

I wouldn't ask more than $1000.

You don't owe him anything.

I'd respond, "$1000 today or price goes up +$50 every day.

Do we have a deal?"

That's right about where my mind is on this right now......I'm going to wait awhile , probably until tmrw to respond....I'd be feeling more kindly towards him, If it wasn't for all his bs.
