I'm going to write an ebook on Ebay. Can I use there logo is it consittered fair use? ALso If i buy a domain like www.theschoolofebay.com (hopefuly I can find something shorter) will they try and sue me? What If I put NOT AFFILATED WITH EBAY IN ANY WAY in a reasonable font in the bottom of the page.

Lots of people do what you are thinking of doing. I think as long as you are not bashing eBay, it should be all good.

Their logo and "Ebay" are TMs. So if you use either without permission, then you're violating their TM. simple as that.

Bash them or not a bored attorney would love trying to get it C&D'd It would be terrible to build up a profitable business only to have them crush it on you when you are at a peak. Do it right from the start and you can rest easy.

Perhaps change it to onlineauctionsguide or something?????

Way back we registered a domain with ebay in it like" blablaebaybla.com" and even beeing a powerseller that time, we received a letter from ebay.....so if you wanna be burned, go for it.....

If you were going to bash them, you'd probably have more rights to use a domain with their TM in it... Such as EBaySucks.com or something like that. Would fall under free speech. These kinds of "company sucks" domains have been long upheld by WIPO, finding that even if there is commercial gain from the site, the free speech issue supersedes claims of infringement.

When you get in to the territory of, "I'm helping them with my site," thats when the true infringement comes. It doesn't matter if you think you are helping them or not, you're essentially profiting off of their TM, and legally, they are obligated to protect their mark from infringement or they risk losing it. So if they want your help, they'll ask for it. Until then, create your own popular brand.
