Well, the nexus 3 - part 2 clearly states a requisite can be conducting business with US.
It seems to me that if youre in the domain selling business trading with mainly US concerns then you do fulfil that requirement. If you can show that you've done logos or a website for a US company then its even better.
Showing receipts of USD transactions in your Paypal, Escrow or Merchant account should prove it.

Overall though, if i was you and I had some valuable .us, then I would open up an office, bank account and LLC in the States which is fairly cheap though you'd have the hassle of processing accounts.
Any large domain trader should do this anyway as it makes some forms of online business and payments much easier.

Resident, no. non-resident Citizen or bona fide taxpayer, most likely yes. If not a resident or citizen, you can file for a US tax ID number and should be able to legally own .us domains. It will however, make you subject to US law, and taxes if you profit.

..as long as you don't open the office solely for the purpose of owning and selling .us domains, which is explicitly stated as not fullfilling the nexus requirements...

But I agree, if you own valuable .us domains, it would be prudent to ensure your ownership by establishing significant business relations in the US outside the .us domain business.

Maybe you could start a website targeted at a US audience, along with monthly paychecks from a US company (Google AdSense anyone?) --might do the trick. Whether that's considered a "significant business relation", who knows? Depends on the size of the monthly paycheck, probably.

On the other hand, if you've only got a handful of .us domains, you could just wait and see. Chances are you're ownership will never be challenged. Plus, according to standard procedure, you'll have 30 days to prove your compliance with the nexus requirements, and if you can't, you'll have another 30 days to rectify the situation.
