Designing a website with audio on

Hi, not sure where to post this topic, (i think this is an appropriate section) but here's what i'm after anyway:

i'm currently creating a website (fansite you might say) for an existing artist, but how much audio can i put on the site without it being illegal

e.g. 30 second music sample clip of a song?

can the song play whilst visiting the site? can the sample be downloaded etc etc?

i do not have written consent or verbal consent, it's more of a fan site, with audio incorporated within a flash movie

just wondering how much is allowed to be put on sample wise

If you can claim fair-use, you should be fine. Since you're promoting the artist, I don't think you should have any real problems as long as you don't offer the sample for download and encode it in a low-quality lossy format to discourage anyone from 'ripping' the audio from your web page. By fansite, I assume that the site won't be for-profit and even if the copyright holder has a problem with your audio clip, the worst thing I can see happening is them sending you an angry cease-and-desist letter telling you to remove it.

Of course, I'm not legal expert. That's just my opinion.

maybe you could check out a site like music.aol.com and embed some of their music in your site.
