.mobi Cingular's attempted grab of music.mobi and video.mobi

Date: Sept. 15, 2006

The new top-level domain “.MOBI” will soon be recognized by the public as signifying that the user of the domain name is connected to the mobile phone or device industry. The applicant, Cingular Wireless, would be that type of entity. The applicant’s mark will describe features of the services, namely, that the applicant will provide music that can be downloaded or accessed via mobile phones or devices.

Arguably the mark is so highly descriptive or generic that it will not be recognized as a mark at all. The mark merely identifies the content (music) and the means (mobile phones and devices) by which the applicant’s services will be provided, and nothing more.

Accordingly, the examining attorney has refused registered on the Principal Register under Section 2(e)(1).

Just think about it, why did Cingular try highjacking video, music & mulitmedia?
1 - To protect video, music & multimedia dotcom.
2 - To ensure they alone will win all those mobi names.

After they had stolen those domains were they going to:
1 - Sit on them to protect video, music & multimedia dotcom.
2 - Exploit those mobi domains making billions of dollars.

Just think about it, which anwser #1 or #2 is correct?
Or am I incorrect and it's something different.

Don,

I don't think this was a defensive strategy.

I think music.mobi and video.mobi are so easy to remember that they could very well have developed.

They aren't protecting their .com IP in this scenario.

Hi Don,

Perhaps Cingular is determined to win those names - "multimedia, music, video" when they come up for auction -- they could perhaps gain some IP protection on the Supplemental Registrar of the USPTO, not the Principal ---

don't really think Cingular is trying to "steal" these very significant "terms" -- more than likely, they have plans for dev them - which is great news for Mobi --
I say let the major telecoms develop these premium terms -- rather than Cool Kat Max who somehow used his trust fund dollars to win "music" and now he plans to use his newly acquired www.music.mobi to promote his latest (really bad) song tracks which he thinks are "masterpieces",

or, the offspring of some famous director whose director father/mother purchases video.mobi to help promote the cinematic garbage of progency (wannabe without talents)...

BTW--I looked at my spelling and vernacular and structure of sentences in my latest post -- pretty bad --- and not very nice to the mobi grammarians -- this is what happens when you wrap gifts, talk on your mobile phone, and post at the same time --- excuses? better believe it!

I agree it would likely be very advantageous having Cingular
developing video, music and mulitmedia. I was happy to see
the SM when I found it in a search on the 17th. Its what
mobi needs for a boost into the limelight.

I did not know that and it sucks big time for dotmobi. I really don't know what to say. Has this made the news because I could not find anything about it.

Far as my post above, it was to show that music, video and mulitmedia were valuable since Cingular had tried for that advantage even if slightly crooked. They were not protecting a dotcom but planning exploiting the mobi TLD which would have been good news.

Again, I feel bad now that "music" is trashed. I hope things go better for video.

The fact that Cingular wants those names really says alot about the potential future of .mobi....

I don't think that it would've been so bad to see Cingular or a company like it develop those names to help push .mobi forward.

I was just giving a "what if" scenario - to my knowledge, "Cool Kat Max" does not exist - my point - let these really high premiums get developed by the professionals,not the amateurs like, uh, me (truth hurts)....
