The new top-level domain “.MOBI” will soon be recognized by the public as signifying that the user of the domain name is connected to the mobile phone or device industry. The applicant, Cingular Wireless, would be that type of entity. The applicant’s mark will describe features of the services, namely, that the applicant will provide music that can be downloaded or accessed via mobile phones or devices.
Arguably the mark is so highly descriptive or generic that it will not be recognized as a mark at all. The mark merely identifies the content (music) and the means (mobile phones and devices) by which the applicant’s services will be provided, and nothing more.
Accordingly, the examining attorney has refused registered on the Principal Register under Section 2(e)(1).
