I saw an advertisement banner today for a marketplace called Catchy Domains.

www.catchy.com

I'm not affiliated with them in any way but I did find their approach quite interesting. I love the domain name itself but I did not really see a lot of catchy domains there. Sure a lot of four letter domains etc but the catchiest name is the name of the marketplace itself. :xf.smile:

Their blatant choice of copying Nutella's colour scheme for nuta is strange, as one wouldn't naturally draw the connection with the domain by itself.

As far as NIKI is concerned, while it's similar in its form and pronunciation to Nike, Niki is itself a very popular first name. I have my doubts that they'd be successful in a claim.

I would not stake my company on it. Imagine buying the NIKI domain and selling anything, there is always a possibility Nike may send legal after you. I don't think I would ever chance it and buy that domain just because it would limit my business very much and I would always have to keep an eye open in case anything I ever sell relates clothing etc.

Catchy is owned by Francois who owns Domaining.com. He's been collecting four letter brands since the beginning of time. :)

He needs to fix the Nuta logo because that's part of how he lost the ADO UDRP.


Another bad claim that was accepted by the panel was that the Ado.com logo was similar to that of the bus company. While both logos are red and include the same letters (for obvious reasons), there is little similarity.

The complainant pointed to other supposed instances of logos on Catchy.com that were similar to logos of trademarks. It seems that the complainant cherry-picked these. Even at that, it did a poor job. Consider this “evidence” of similar logos:

Catchy doesn't sell domains less than $50k which means its not worth it for any of us to make a bid considering anything over $50k is end-user pricing.

If someone is looking to spend over $50k they probably won't be browsing the website for a brand. So most sales will come through type in traffic.

Which leads to... what is the point of listing your domain on the website for a fee when your offers are probably going to be from direct traffic anyway?
