This question might have been asked before.

If a .com domain exists and it is says R after the name with circle around, but no TM, can I buy any other extention and run my site.

Eg: ebay.com exists, if it was available, could I have bought ebay.in and had my own site.

If NO, then Is there any scenario where this would be acceptable to change tld and run site

TM is trademarked = Trademark has been filed.
R circled = Registered Trademark.

A registered trademark has gone through the approval process, fee paid, and has not been disputed. In other words a registered trademark has even more legal implications.

That's not true, TM does not mean a trademark has been filed, TM means you believe in a good faith judgement that your name or logo is unique enough to be Trademarked, and thus, is trademarked to you.

(R) means a registered trademark filed with the USPTO
