lets say there is person name ( theoretical and fictional)

Somename (first name) auction (last name)

Is it legal to buy this domain?

I dont want to buy it, I just noticed that there is someone who has a last name like a domain extension, and it's intresting to know if he can buy it.

If it's not a restricted extension, then of course they can. Example of restricted extensions:

and lots of ccTLDs

So it doesnt matter if its similar to that domain extension, that person cant claim this is my name...no one can buy it...

there is no trademark or copyrights on name, from what i understand...
