XFactorForum.com- I know that xfactor it's a TM, but you can use this as a music related forum, with xfactor section or a general forum, with a big xfactor section, using a boost from 3600 exact match searches and 100k broad match
BerlinHotel.co -22k exact match searches, good for website reviews about hotels in Berlin or even for a hotel owner in Berlin, to attract more views

I cant see any value in these, you really need single keywords with an extension like .CO

I would stay away from the X Factor name, unless you have permission from them to use it. You've shown bad faith by putting it up for sale on your site already, thats enough ammo for them already

Just stay away from TM names, its that simple

Regarding xfactor, they have TM for tv shows not car sales, forums or something else. I cant show bad faith if I want to use xfactor name for a website reviews, let say.
Regarding berlinhotel, I dont think that it has value the name but it can have value for attracting and monetize for keywords. I dont think that if somebody it's using a search engine to look for hotel in Berlin, he will notice the difference between berlinhotel.com and berlinhotel.co. It's about making money using the name.

oh ok, sorry I thought you were talkigng about a music forum, that would be infringing, with a car forum, you will be fine, its all about usage

I understand what you are saying, its about how hard it is getting your name above all the other sites on Google though

You have to compete with sites like TripAdvisor.com, Booking.com, Hotels.com, LastMinute.com, Expedia.com etc

Like this, everbody will be happy: you have extra views for your website and they are happy, because you dont compete with them.

Regarding Berlin Hotel, whatever you want to do, you will have to compete with the big guys. At least, it's good to have an advantage. If you try to type in google ' berlin hotel', among others like expedia.com or tripadvisor.com , in first 20 positions, there are 4 which they use berlin hotel in the name. So it works, if you have the right content and right domain name. It could be much harder with a name like gdt.com, which has more value, but not to be used for something particular.

You don't understand how TMs work, ask the question in the legal section and see what replies you get from the experts

It's possible. I had some years ago some TM issues, but for european market, locally, and I was right. Hopefully I will not be wrong about this. It's not always easy to be right and prove in the same time everthing regarding TM.

This is from Lanham Act: 'Fair use allows commentary or criticism that incidentally involves the use of a trademark so long as such use is for a purpose other than that normally made of a trademark. When a party uses a trademarked item as a component of a more complex product, collateral use allows the party to identify that component by its trademarked name.'

In this case the general forum it's the 'complex product' so you have the right of 'collateral use'.

There are 2 words sales on .co this year, at low xxxx, but I dont know exactly about geo domains. But I have some related websites, and with 22k exact match and more than 100k for related terms( hotel Berlin, hotel in Berlin and others), for sure you can make money from it. If I will not get a decent price, I will developed myself when I will have the time. I always buy something for the value on the market or for the possibility of making money when developed.
