Hi everybody
I am wondering about these domains if they come under the Trade Mark law. You feedback is highly appreciated. Can I sell or develop these?

I have found on Sedo many domains containing the barclays what is the future of these if all the domain contain barclays are illegal ?

Dont go near them. As you know/must have an idea Barclay is a big bank company. Ay domains close to ones they use im sure they will take away from you.

Yes but the names listed above where all to do with Barclays bank not just the word Barclay.

May I ask why it isn't a TM?

I believe they do business commercially and are well established, right? That does give them a TM in many peoples eyes (like courts).

However, with the domains in question and given Barclays seems diluted, much would depend on its usage. If you offered finanacial services under the Barclays name, then you would possibly be infringing on thier mark on the financial business world. The samples of other "barclays" are in different fields (I just glanced brielfy).

Just like Apple and Windows, the names are TMed in certain catagories. You have Apple computers and Apple records. Two completely different fields. But when Apple computer started offereing music, a suit was filed by Apple records for infringement. I can't remember at this moment the status of that.

So this may be a case of how the names are used. But if you show bad faith, rest assurded you could lose them.

imho these contain no reference to the bank and are perfectly fine to do what u want with them.

As mentioned, the name in itself maybe be ok, but the usage would play a huge role whether bad faith could be proven. IE- You offer competing banking services... that would be bad.
