I think thatโ€™s pretty chintzy to accept a domain for half its worth on default because the seller said 48 hours after the last bid. Especially when a bid is made before the seller even sees and replies to the thread. If I were Mr. Johnson, I would take the negative trader rating or continue on with this thread.

If you wanna start getting technical, he also said

You're conveniently leaving out the part where Mr. Johnson says "Current bid of $82" which at the time was by whitee. If the seller had a problem selling to that member, don't you think he would have said it at that time rather than saying he has the current high bid?

If he has a problem breaking that rule of his terms (Regular Members only), he should also have no problem breaking the term saying 48 hours after the last bid. I guess we can take them as more of a guideline than a binding legal contract, then.

Hayes, The seller set the terms in his original post, as required by NamePros rules. "Auction ends xx hours after the last bid" is a perfectly legitimate and acceptable deadline. In fact, he is REQUIRED to honor the terms he set, or risk putting his account in jeopardy.

However, the seller may NOT change the terms after a bid has been placed. Therefore, his "regular members only" addition would not have held water -- he would have had to say that before bids were placed. You were too late. Fair and square.
