It's a long question, but needed to fully understand the situation. I appreciate any help I can get!
I'm opening up a game related to wrestling. Basically, I know that certain wrestler's character names are trademarked by their respective companies or even by the individual himself - IE. "The Ultimate Warrior," "The Undertaker," etc. However, the real names of these individuals are obviously not trademarked. Therefore "The Undertaker" can be identified as "Mark Callaway." However, a wrestler like Chris Benoit, who's real name is the same as his in-ring name, which he has used in multiple companies, is not trademarked, obviously since it's his legal name.
The game technically revolves around the performance of the individual who in turn is portraying a character, although their performance can also be affected by things unscripted and outside the ring, in real life. I know I can't identify the pro wrestlers if the name is trademarked. So, I know what i have to do is to identify them by their real name - i.e. Undertaker becomes MCAL for Mark Callaway.
The problem is, some players won't automatically be able to identify the Undertaker as Mark Calloway, so I need some way to list in-ring personas and characters the wrestler portrays without stepping on trademarks. The company that The Undertaker (Mark Calloway) works for just happens to be very stingy about their TMs and go so far as to send C&D's to fantasy roleplaying/writing sites that use their character's names.
What are my options? What if on each person's profile page I had a link, or better yet, integrated information from Wikipedia? Would using a free, encyclopedic public source such as Wikipedia allow me to use that information? For example, if you check out http://en.wikipedia.org/wiki/Paul_Wight it says "Paul Randall Wight Jr. (born February 8, 1972 [1]), better known by the ring names (The) Big Show and (The) Giant, is an inactive American professional wrestler best known for his runs in World Championship Wrestling and World Wrestling Entertainment. Even though he is currently inactive, he still remains contracted to World Wrestling Entertainment." The profile/entity name on my game would be identified only as Paul Wight, and then on that profile page, it would say whatever happens to be on Wikipedia. I would never mention the trademark myself.
