I currently have a domain which I am considering registering as a trademark and would prefer not to discuss the domain name.

Would you be so kind to please let me know ,which is the best company that you have used or know about to register a Trademark ,also opinions on which would be the best approach to register online and options available.

Your opinions would be very helpful and appreciated

Trademarkia not cheap but good. Fees do sneak up on you at thee final end.

In the end my task was done and proper but I used legal zoom to do some other stuff (I know they do trademarks as well) but the way stuff sneaked into the basket you really, really have to pay attention and the up selling involved every step of the way is such that I would definitely look elsewhere before going there again.

Any Idea of Total end cost and the time frame that it took from Start to end

That's a bit like asking "how long is a piece of string". It's entirely dependent on the complexities. I didn't follow thru but I found a number of trademark companies which would provide a simple service for approx $1k, IIRC.

Thank you , just needed a ballpark figure so can budget, better to over budget than under budget ,much appreciated :)

I would go to directly to the source. uspto.gov

Cut out the middleman so you know exact cost.

I wouldn't suggest doing it yourself unless you are well versed with trademarks and trademark law. I think using a specialist trademark firm could make many suggestions which might make sense down the road. I think they are worth their fees to handle everything correctly and to cover your possible legal problems. I think going it alone with USPTO costs $300-$400 IIRC, and a specialist trademark firm might charge you $1k all in. I think it's worth the extra costs, if you are unfamiliar with Trademarks, IMHO.

Trademarks have to be used.

If the Trademark, that is publicly viewed, a competitor with swiftness can effectively kill off all value of the original domain and the costs associated with your Trademark, and a simple filing can scare off any purchase.

Process is a year to obtain a Trademark. The problem comes with competitors with in-house legal.

The term is " in use commerce " The time you have from approval to this time frame has to be managed.

Register a Copyright which in time gives you common law ownership of the trademark and is evidence of the date you started using the name as a trading name. A paper trail is as good as a Trademark these days.

go here, its free. copyrighted.com

back in 2013 the 50 shades of gray movie company trademarked my name "Charlie Tango", not only that, they made a radio communication reference in the film too. What makes it worse is that they brought a vibrator out baring my brand name lol. The Trademark they got was for the name Charlie Tango but it was for almost every class category EXCEPT radio communications which my brand associates with.

People dont believe them when I tell them but its 100% true lol

I have had my name copyrighted for the niche which it is used and I have used the name since 2009 and own the .co.uk domain and the .uk domain too. They don't have any domain in relation to Charlie Tango which is good. I legally own Charlie Tango trademark through common law having used the name before they did and with full evidence and paper trails. I could pay for the trademark but it's totally unnecessary

I was looking at development on the site so that would be classified as being used as the domain would not just be parked ,please correct me if I stray :)

Yes you have to use the name to trade to qualify for a TradeMark. However, you can copyright any work, images, names, website layouts, scripts, HTML etc etc and a registered copyright shows you are using the name from a specific time and date.

As soon as you open a website and use it with the name, get everything copyright protected as you go and all the paperwork and digital copyrights give you protection against court action from anyone trying to lay claim to you name or brand.
Its an idea to design and copyright any branded items as soon as possible but DONT put them on public display until your website is good to launch as a revenue making business.

You're very welcome. I learned a lot from experience over the past 10 years of building websites. Always happy to help.

Lastly, I'm in England, different laws may apply in the U.S and other countries so always check first.
That said, still copyright everthing...it will offer you protection from brand thieves and opportunists.

It's much safer to not park any domain with a trademark because of the tendency for the parking company to put ads on the domain related to the trademark or it's competitors. Which will usually cause Bad Faith Decisions in any UDRP.

I personally have never gotten one but I have also heard that's how some companies try to reverse hijack domains.
