Now that McDonalds has lost it's final appeal against Malaysian company McCurry for the 'Mc' being it's trademark, whats to stop a rash of McNames appearing as fast food or any other businesses?

who's got a 'Mc' domain and how do they use it currently?

I wouldn't recommend registering such names. I'm sure they will still try to fight each registration on a case by case basis. I don't think it's worth the hassle unless you have a team of lawyers ready for court. Ebay previously sent me cease and desist messages on names I had which contained the word "bay" in it (not even "ebay", just "bay"). Had I gone to court I know the case would have been in my favor, but it just is not worth the trouble.
