Hi everybody, have not been here for some time! I have been in talks with my partners on how we should develop STREAM.TV and thought why not get some suggestions on this matter from the experts :) Any good ideas? Thanks in advance!

Its an interesting name, I like the name but development is going to be tough from a monetization standpoint IMO.

Then you have Ustream will they say that a service that is competing is confusing ? Who cares if they are right, if they push that then you still have to defend it.

Its what I like to call a trap name. Its a name that is good and traps you into thinking you have a goldmine, but there are a lot of obstacles on the way to the mine.

i have streammovies/tv so that's pretty obvious , as for your one

movies
games
sport specific channels

as a personal note i am waiting for an appropriate affiliate situation

i think you r name has potential, you just need to focus on one aspect i think

we all face the same problems with .tv names

I would like to say one thing regarding that! " Im not going against their Trademark that was filed like 5-7 months ago and nobody opposed it... YET ... but their domain is what 2006? 2007? and stream.tv is 2000 ... " Ive got a Lawyer in their state that says I could oppose...

The experts on development are not here. Maybe a couple. But if you want to sell it you've come to the right pace.

I feel you ought to prevail in the TM situation but it could be expensive.

two different words and two different websites , i really don't see how this name imposes on ustream , the world has gone mad , of that there is no doubt

simply try to offer a different service if worried

When you bought the name or when it was first registered has no bearing on your legal right to use the name in a similar way that legally "produces confusion in the marketplace". Whoever first launched a website using "stream" in the context of "UGC streaming media" owns that use of the name. You can put UGC streaming media content on Stream.tv, but if you get a 'cease and desist' or are otherwise sued by ustream, they will bankrupt you, regardless of who is right. And, btw, they would be right.

Also, their lawyer will find these posts on Namepros and use them against you, showing that you were aware of a problem. You should NOT discuss this on an open forum on Namepros as it is all legally admissible evidence against you in court.

First off you did not reg in 2000 so let's throw that out the window. Secondly I did not say you are infringing or you would not win. I said it that its added cost. So you spend xx,xxx defending the name against Ustream for example, that is a real cost.

The other thing is what is the business model ? That's the key. Best of luck with the name.

I would go with adult site :)
Live adult streaming is kinda hot and profitable at the moment. Check streamate dot com for example of similar, adult name (NOT SAFE FOR WORK).

Based on some of my own legal battles (eg. Sun Microsystems;SUN.COM vs MicroSun Computer Services;MICROSUN.NET), I can tell you that this domain comes with considerable legal exposure should ustream get an itchy legal trigger finger.

In these situations, the biggest guns normally prevail. With that being said, I think you're okay with the domain as long as it stays parked.

The developer will be the one with the exposure. IMO.

The names is overly broad, would not be developing it, especially as a domainer. Hold for resale or sell.
