What would you say then? That the designer was heavily influenced?

Sorry for the double post. You guys are right their isn't ripping involved. He did copy the background image and the border. The color theme is also pretty close to each other.

There are many places that sell backgrounds, templates, borders and so on. Many times you may see simular designs by two different designers as they both buy from same place. It's best to make sure they are taking items from others before claiming they are. The background looks like one I may have seen forsale once, not possitive though.
