Wbsite design on defered pay

I agreed to out together a site for some and she signed a contract (she requested to defer the payment so I agree to collect a few months after her business opened.

Now, she is asking me to deliver her website and not charge her any money??!!!!!!!! what shall I do just try to talk it out or take her to small claims court??

Have you provided the site to her? Inform her that you have made a legally binding contract and that you have performed your side of the offer and in return you expect to be paid. If you do not receive the money within an acceptable or reasonable time frame then you will pursue legal action.

One thing worth noting: not sure what country your client is in but I know that in the UK if you get a small claims court judgement against a company, it goes on public record, and can ruin their credit rating. So often merely making it clear that you are perfectly prepared to go to court will scare the client.

Also dont forget in the UK that you can charge interest on unpaid invoices, because of the Late Payment of Commercial Debt (Interest) Act 1988

What is the price for by the way? Have you made delivery or informed her that you want to make delivery. If you havent you should do it now also. But it sounds like your wayyyy past that

3. If you designed the site and didn't transfer the rights, you may have additional rights through either copyright or trademark laws. If your contract required ownership transfer of these, then she may have breached meaning you still own them. You could send a letter to her hosting company demanding the site be removed for copyright infringement based on the facts that you wrote the HTML, text, graphics, and/or script and have not transferred license to use or ownership since you were not paid. Provide them a copy of the contract and offer evidence that you created it.


Hindsight: Always get at least 1/2 up front. - Better yet, 1/3 advance, 1/3 on upload, and 1/3 deferred.

For that amount of money I would chase.....
