Hello all,

I did a small website design for a client a while ago and sent her the files and we agreed on shared revenue, 50/50. I inquired to her today whether she could pay me out of the partnership, I sugested $20 to cover the design. She then told me her computer got a virus and she gave away the domain. Is it legal for her to give away the domain. It was in her name. I have records of all her conversations also (including our agreement (roughly)).

I'd like to hear your thoughts.

Thanks alot,
James.

Do you have a written contract? If not, you are probably out. What she did was probably legal, but not ethical.

In most places, verbal contracts can be enforced, but there is little evidence to make your case in court. Unfortunately, it sounds like all you earned was exprerience.

If she sold the domain you should request half the proceedings. Try to be nice and negotiate with her. Remind her of the agreement and that you are dissappointed that she sold the domain without coming to you first. Legally you may have a case but if the value of this is below $xxxx then it's most likely a dead cause. If you are discussing $20...just consider yourself screwed and the most you can do is expose their reputation.
