not sure how it works with template monster but it looks to me like he is an affiliate iwht template monster. so he maybe allowed to sell templates through his affiliate id

This is indeed illegal. You get 20% commission off of each Template Monster product sold. If a template was $50, the cheapest you could sell it for would be $40 without losing (or making) any money. Template Monster templates can not be sold in bulk or on an unlimited membership download basis.
