I have a domain (confidential) and couple days ago I received a letter from well-known company that has its branches around the entire world stating that my domain has a TM issue and I should hand it over to them at my own cost.

What should I do?

I had very nice experience with Business-Week.info lately, but this time I hope I don't wet my pants because this time it's huge ... it is about REUTERS !

oh oh since it's their tm they got a hold on you here not unless you wanna fight back and "snatch" the domain from them you're gonna need a legal service for this and it will cost you.

and since they're in the media you have one tough opponent here, how news can fly easily with your name on it?

I don't really want to snatch the domain ... I will be more than happy to transfer this domain to them for a little fee of $1K

Do you think they will pay $1K to get it with no hassles, or they will start legal battle that may be going for years?

that could be likely their next step if you ask payment from them. from my standpoint if im the bereaved person with tm taken away from me, i would require they pay me and put them in jail. that's basically how they will feel about you sorf of blackmail. these are still my opinion about it, don't hold me accountable still you need a legal advise about the whole situation someone who you can trust imparting sensitive issues.

on second thought if it's really they're asking for it, just let it go, there are other domains lying around waiting for you to register them, it's no big deal.

I am not going to ask them for money, Instead I will ask to pay transfer fees which are sorta a little high ;)

If Possible, you could ask them for a little less, like $250..

If you go to court on this issue, there is a 99.9% chance you will lose. Additionally, if you try to exhort money from them, they could potentially drag you to court, have you pay all of their legal fees, take your domain, and get restitution for any profit you made off the domain. That being said, it will cost them thousands of dollars to do this. The only thing you have going for you is knowing they will have to pay a bundal in attorney's fees. If they want to make an example out of you, they can. If they are reasonable, they probably will offer to give you a nomimal amount of money for the domain.

I would not get greedy in this circumstance. Give them the domain, but stipulate you do not owe them any money in damages. Get this in writing!

If you have more questions, speak with a lawyer.

These guys have a fleet of lawyers. Do you think that they are going to be fooled by semantics?
They are required by the trademark rules to persue this. They will not, IMHO, simply pay out because it would set a precedant for anyone else who wants to use their trademark.

I would hand it over. Would be nice if you could get them to pay you for it however? That or sell it to someone :D

ditto here... you're screwing around with the wrong people... also for future reference if you retain anonimity on the domain do so on the friggin TM-contestand too.... all it takes is a google search to find this thread and use in court to sue you for a few million $ damages + charge you as premeditated TM-squatting

Ask them how much they would be prepared to buy it off you for.

Looks to me they have already indicated what they are prepared to offer.

i'll say hand it over before you even get into any legal issue because you 'll not only have to give up the domain, you'll be fined also :) it is just like pleasurizing, using somebody else's work and saying that it is yours :)

Does your site have anything to do with the company? Don't transfer to domain to them becuase it costs too much. Drop it or sell it to some sucker ><.

If you sell the domain to another party or drop it, you may still be liable for damages. Just about anything having to do with bad faith can get you into trouble on TM issues.
