I have few questions for experienced NP-ers.
I made my last ".mobi" registration yesterday. Now I have a lot of work: have to develop some of them and try to (re)sell others. So I rechecked once again TM issues for all my domain names. I noticed that there is new TM registration for one term (2 generic words in english). I registrated domain name with that term in january. That term has been trademarked in february. :imho: that is one of my best domain names...I like it very much. I didn`t have it in mind to sell this domain name now, because I`m sure it has value. Could TM holder (some USA state agency) take away my domain name if I offer it to them? I intended to sell this domain name to other end-user... Would there be any problem to sell such domain name to somebody who is not TM holder and would he have some problems later by buying this already registrated TM name.
I also registered one bulk of 5 .mobi domain names (which contains 2 and 3 generic non english words, but like terms, those are worldwide known...something like sandwich, pizza or juice). I carefully checked TM issue and I think there is no problem with it. That terms are used as part of full name for some products, but there is always next disclaimer: "NO CLAIM IS MADE TO THE EXCLUSIVE RIGHT TO USE "xxxxx xxxxx" APART FROM THE MARK AS SHOWN". I want to offer that domain name bulk to end-users now. It is very large industry and some big players are in mobi game from the beagining, some are not (yet). I want to offer my bulk to industry leader which has registrated more than 20 mobi domain names till now. He owns ".com" for one name, but that is not real site, it`s not parked page either. Other ".com"s are either redirecting pages or parked pages with private whois data. Is it bad faith to offer my names to this leader? I don`t want to go to the auction and I want to offer names only to him ... should I mention that in my offer or should I write something like "if you are not interested, I`ll offer that names to your competitors"?
And my last question: I registered few 4Ls.mobis, because I was late for 3Ls. Few days ago, I discovered that one of my names is acronym for new product of one big ".mobi" investors. Should I offer it to him? Is it bad faith? (full name of that product has not been registered in ".mobi" yet, but anyway I don`t want to registrate full name inspite I didn`t find TM issue about it. Products full name is very long and I think my domain name acronym will fit better for ".mobi")
Should I asked proffesional broker`s help for my dilemmas? If yes, could you suggest to whom should I advert to?
Tnx in advance for help and for reading this long post!
