I suppose the first question should be...

Did you send spam?

This reminds me of the scene in Casablanca where Rick says:

"I came to Casablanca for the waters"

"But, Rick, we're in the desert! There's no water for four hundred miles."

"I was misinformed"

Well, then you've gotten every penny's worth of your Namepros membership already.

to be honest with you, the domain is not even worth $2... drop it before it cost you more money! %%-

Unfortunately DirectI/PublicDomainRegistry has to be strict due to laws within
their jurisdiction. IIRC there's an Indian law on spam or similar that essentially
places liability on service providers, including domain registrars there.

It's a $2 lesson.

People come here all the time trying to find justification for all of the illegal/shady activities that they participate in. This is not to say that you are that type, but we can't assume that just because you are here asking for legal advice that you haven't done anything wrong, that's why the question was posed. :)

Honestly, I'm not sure what you can do in this situation. I'd try to contact DirectI and ask them for proof that the spam originated from your domain. It's easy for people to forge the From field in emails, but usually if you look at the properties of the email, you'll find that the originating host is not from the actual domain. Also, if your site was developed, it's possible you had a vulnerable contact form that would allow spammers to send spam as if it were coming directly from your site (which it would have).

For $2, I wouldn't worry though, unless it's a domain you really want or had developed.

...and which depends on whether this is a hosting issue or a domain issue. When a registrar provides hosting, email, and other associated services, then we are talking about an entirely different set of policies and considerations than those which apply strictly to domains.

...for which you are trying to inflate the traffic figures by spamvertising it here in the forum, eh?

I say we have the mods terminate his account and ban his IP.

Heh.

I love the guys who apply Rule #1 - Spammers Lie - to anyone who is trying to absolve themselves of an erroneous spamming accusation. It's like witch-trial logic.
