I whoised my domain name earlier this evening to check my domain name and then I noticed that it's listed at afternic by someone else. I have listed it myself at sedo, but nowhere else. (Yes, I'm sure).

Since I'm not a paying member at afternic I couldn't contact the person, but of course I can contact afternic, and I'm planning to do so.

Anyways...What I was wondering was: It's not legal for him to put my domain name for sale without my consent, right?

It could be possible that your domain was listed by the previous domain owner.

I've considered that possibility...How can I find out? I bought the domain from 1&1, but see that it has a previous owner. Should I just contact afternic? I don't want him getting into trouble if it's just a mistake. I see he/she has many other domain names registered on afternic.

This is a very common occurrence. People sell names or let them drop and forget to remove them from Afternic or other sales sites. Afternic is very good about handling these incidents. The person who has it listed will not get in trouble. Just contact Afternic, let them know you are the new owner and ask that it is removed.

what does the Whois data say? If you are not in the offical whoIs, You anit got the name!

Not entirely true. Note that with Domainsite, a name can be pushed to another account and if the pusher doesn't remember to check the "update contact info" boxes then the whois info will remain as it was, although the domain is in your account and you can change the whois info if you notice this. This happened to me a few times.

The issue has been resolved :) It was just the old owner who had forgotten to remove it.

Speaking of which... I need to take some domains off SEDO, thanks for the reminder! :)

Thanks for the thread. I have loads of domain names that are still on sale on sedo from previous owners.

Will have to make a list and remove them.
