Hi everybody

I have just become a member of this forum and must say its looks great.

I am the owner of the followng domain name www.shayneward.com

Its the first domain name i ever bought and i am in two minds of weather to sell.

I have an offer of £1000, the dilemma is can I get more or is this a high offer?

If you do a search of Shayne Ward you will see his profile is rising everyday.


I await your advice with great anticipation.

Tough call. Accepting could mean a lawsuit. Asking for more could mean a lawsuit. And doing neither could mean a lawsuit. I guess the last one is the safest route. If the offerer wants it bad enough they will contact you further.

I see that you have it parked at SEDO. MIght aswell go ahead and accept because if they were interested in taking it from you, you've already lost.

Incorrect. Refusing a lowball offer would not mean a lawsuit, and accepting a fair offer also wouldn't. There is no law against turning down (or ignoring) a potential buyer. Likewise, agreeing to a higher offer deal means they now own the domain, so they can't squawk.

The only real mistake to be made is by the seller, if he first offers the domain for sale on his own. This is a tacit admission that he had bought the domain for the sole purpose of mercenary sales. THAT is what ICANN/WIPO looks down upon when they decide domain disputes in arbitration court.

Short version: Don't advertise it for sale but accept an offer of $2,000 for a domain, and you're sitting pretty. But put the same domain up for sale and demand $1,000 for it from day one, and you're dead meat!

so I guess you are saying i should accept the offer?

I should I take a gamble and offer the site at a higher price, say £1200?

if you were in my position what would you do?

I'm no lawyer but I do know that accepting any offer whatsoever could be used as substantiating evidence. This case in particular it appears the seller is obviously trying to sell a celebrities name. Apparently has turned down previous offers. So one would assume the intent is to "profit" from what could be considered a trademark.

I'm not going to suggest what anyone does regarding his or her income. All I can say is play it very carefully. Being too greedy could cost you as much as $100,000 in damages in the US.

Then you have a good point. You can just ignore the offer and wait for a new one from them. If they are interested they will no doubt contact you again. You also can send them a letter that at the moment you are not interested to sell the domain because you're planning to develop it. Find someone with the nick or get your own old nick Shay Neward to make sure they can't get the domain by lawsuit.

Just find someone else that has this name: Shayne Ward
and become a friend of him...
:)
Anyway I noticed that you put it for sale so thats enough for lawsuit...

The fact that you do know who Shayne Ward is and want to know if you can get a "higher" offer does suggest bad faith.
