Selling .com to .org owner with no trademark

I have a question. I have a domain in the .com version and I have discovered a fairly large company that has been in business for 20 years operating under the .org. They have no trademark on the name.

Is it OK to offer the .com version to the owners of the.org without expecting a problem?

Has anyone here on the forum had a similar experience?

Does that 'company' qualify as non-profit somehow ? If they registered the .org as a third choice (.com/.net taken) you might have a chance, but the use of .org may be a deliberate choice. Many .org holders would never trade their name against the .com, because they want to emphasize they are non-profit.
But you say they have been operating under .org for 20 years, that is since 1996. There were plenty of good .com back then...

To say that they have no trademark is tricky. You mean they have no registered TM.
If they are very well known by their current name, then they have TM rights of some sort.

Is the name a generic term ?

Also , by checking WHOIS , you will likely find out if they had opted for the .org vs the .com back then.

In any case, you say they have been working under .organization for a long time, that is subsequent to 1996. There were a lot of good .com back then.Also , by checking WHOIS , you will probably see whether they had selected the .organization versus the .com in those days.

The company is about 20 years old. I don't know how long they have had the dot org, but the dot com was owned by someone else (not a domainer) for a long time.
