Im starting u a webiste, however, I want to purchase the domain name shotbro(dot) co.nz
However there is already one under (dot) com... My webist eis going to be quite alot different in terms of material and ideas for the site etc...
Is this legal to have this domian name??

Are you providing the same services? Same field, so to speak? IE both game related sites? Or theirs is gaming, yours is computer sales? (just as an example)
