Registering the .net if .com already exists

I'm interested in registering a domain with a the .net tld for the purpose of starting a hosting service. I would register the .com version though it currently exists. The domain seems to be parked advertising hosting services, though they don't seem to be selling anything.

Should I be safe and not start my business since the .com domain exists? or would it be okay to register the domain and start a business as the site is dormant.

I've attached a document of the currently existing .com site.

Also, I was wondering if there are legal concerns if for example I purchase besthost.com if hostbest already exists?

Thanks a lot!

Steven

Ideally you should probably by a premium .com domain name.
What kind of hosting business are you starting? I'd be willing to partner up with you, as I have a few good domains I'd like to use. :)

It depends what the term is. If it is a generic like WebHostingServices.net that is fine. If the term is very descriptive like a business name like JoeBlowsHosting.net and the .COM exists you might have issues.

Then again if the page is parked it is normally some type of generic term. Without more details it is hard to give you much more advice.

If you love the term check out www.uspto.gov for any possible Trademark issues.

@EGS : Thanks for the offer, but I don't think I am looking to partner up as of now.

@bmugford : Thanks for the great website! I'll be sure to check it out. The domain is something of the lines as lets say... mercuryhost.net (of course this is just an example)
