I was able to pick up these two names in the 5th day of EAP for a great price. All the highly targeted keywords like news and porn sold in the 2nd day of EAP for around $3,400 each. Please share any of your .now, and your thoughts on the potential future. For some reason, I prefer this extension to .deal that also is in EAP.

Yes, I was receiving this error message because I was checking my own domains.

I received a reply from Sedo just now, as follows:
"It is not possible for you to buy your own domains on the marketplace, hence the error message.
Your domains have been successfully verified and listed for sale for everyone else."

I got 6 back this afternoon . Hola and Snatched rejected. Mobility, Apparel, Diva and Donuts approved. Approval price lower than expected , between ~$4500 and $6500.

Congrats. This is also why I've not been listing single dictionary words - I was worried they'd approve but at lower prices than I wanted. And if you reject their suggested price - the word is forever tagged with the tag as being rejected by atom (even though they actually accepted it and you are the one who rejected it due to pricing)

I wanted to get pizza a launch but it was snapped up quick. Seller now quoted me 60k. Next time! Many great names listed.

When you try to buy some good domains, Namecheap gives a trademark warning in red "A Trademark has been found for this domain". Some examples are:

- Fantastic (.now)

Yes I got that for some also. It shows you the possible TM clashes and lets you decide if you want to proceed or not. Its up to the individual to make the call.

Also, would you sue namecheap if you bought a domain and then had to go to ICANN court because you received a claim against your domain that namecheap failed to warn you about? It shouldn't be on them to warn you about IP infringement among 194 countries but once you begin to offer this service, do you find yourself legally obligated to cover all IP for all names?

The trademark notice only shows if the company added their TM to the trademark Clearinghouse. You are correct of course, that almost all dictionary words have myriad companies using them and likely many/most have TMs. So really, unless you're intention is to build a competing site - the TM notice shouldn't bother you (or an end buyer).

Where the TM may matter for this TLD is if there is a TM for FantasticNow.com (and you're seeking to reg Fantastic.now). It may not come into play - as the TM holder may not UDRP and/or notice (or care) and the end user/buyer may be putting up a non-competing, non confusing service. However, in these instances care should be taken before registering (is the TM still in use, company active, etc).

But for general dictionary words - the registrars show any and all TMs that are in the clearinghouse - and it really is irrelevant to us (however, of course any TM holder can UDRP for any reason and you the arbitration panel could claim bad faith for any reason so ymmv). But really that's the case whether or not this TM notification pops up or not and is true for all TLDs.

also - I am not a TM attorney, so you should get counsel if you need TM advice. This is just one laymans opinion and should not be relied on
