So is there anything that can be done, i.e. class action, etc., if we have to spend money transferring our names?

Shouldn't icann have a system that protects domainers?

Class actions make money for the lawyers. The recent Google click fraud case for example, the lawyers for both sides got together and made a deal where between them they got a huge amount of money ($350 million for plaintiff's attorneys if I remember correctly), and the "injured class" got coupons.
