NASDAQ word in domain name (TM)

Hi,

Does anyone know if NASDAQ is a word with TM issues??

As the name of a stock market I didn't think it was a trademark, but I registered nasdaq-index.com and when trying to add it to my SEDO list they wouldn't allow me to do so because of germany trademark laws.

Is it just a german thing or will I have problems everywhere?

I reg'd NASDAQListed.com and sedo wouldn't let me post it either, but Afternic did let me.

NASDAQ is a registered trademark -- in no way can it be portrayed as a generic word unlreated to the actual TM.

It doesnt work like a company, i doubt they sue someone unless its too big or redirect to adult sites

It seems they go for all the nasdaq names so, what should I do? Just await for them to contact me and then transfer the name?

While the listing of transfers to NASDAQ is scary, it makes a good point with all the TM issues flying around this board... Just because they have a lot of "wins" with WIPO doesn't mean they won because of the use of NASDAQ in the name. Check into the individual facts of each case to see what happened, and you can see why WIPO ruled like they did and, consequently, get a better understanding of using TM's in domain names.

I read all those transfer listings and in many cases they were redirecting the page to pornographic sites and things like that.

In my case, it is only for reselling, which I think might be considered as "bad faith" acting. Im not quite sure about that anyway.

Also, I think "Nasdaq Index" is a commonly used term for a reference value to brokers, so I thought I would send it to some broker agency or something similar, not directly to Nasdaq or competitors.

Let's see how this ends, the worse that can happen is that they contact me offering to pay me the godaddy registering amount in order to transfer the name to them.

We owned a fairly high profile domain with NASDAQ in it, and not a peep with regards to IP issues. Of course, we were holding it pending site development on behalf of a client, and it fell through after the tech bubble. It was never redirected to any sort of porn site .. YMMV!
