.name restrictions

It was my understanding that there are restrictions on .name registrations - namely that you can only register your actual name. Yet I see a lot of people who register all sorts of .name names which are quite obviously not anyone's name. Names such as Theft.name, Reserved.name, Exclusive.name, etc.

Have the restrictions on .name registrations been lifted, or do the registrars just not care?

There's nothing stopping you from registering exclusive.name, but if someone were to dispute your claim on the name, you would have to prove that you are commonly referred to by the nickname "exclusive". You can't just say that people call you exclusive, you have to prove your right to the name.

I don't care either way - I just wanted to be sure that if I register a couple of names I have my eye on, that I won't run the risk of losing them should a competitor decide to cause trouble. According to the rules, I will lose the names if a dispute is lodged.

What is the likelihood of someone filing a dispute? Probably pretty slim as it costs around $1500 to file. It is interesting that GNR don't care enough to enforce the policy, so .name registration might as well be open.

Unfortunately, according to the ERDRP, you must prove your right to retain the name. That means you would have to prove that you are commonly called "exclusive" and may be required to provide documentary evidence. The complainant does not have to provide proof that you are <em>not</em> known as "exclusive", merely raise the objection and pay the fee.

The fee is what saves us all from the likelihood of being challenged on names. $1500 is a lot of money just to harrass someone. Chances are, only a cashed up competitor would be able to afford that.
