My Content Has Been Copied - What Should I Do?

Hello All,

It's just been brought to my attention that someone has copied the content of one of my sites completely.

Here's my site: www.ionic-health.com
Here's his site: ionic-bonds.com

I'm concerned that this will cause me to get zapped in Google and the other search engines. What action should I take about this? I'm pretty darned concerned about this and find this to be pretty uncool.

I thank you in advance for your advice and would appreciate your wisdom.

I would immediately send an email to the email adress listed on whois, threatening a lawsuit, and then after 3 days max, I would take him to court/notify his host of copyright infringement. Good luck!

Wow that is pathetic of that guy but if you notify his host they might close his site down but they dont always at first also I dont think you can sue him if you do not hold a copyright to his website but I might be wrong.

You could report him to his registrar for having false WHOIS info. I believe that is called a Nexus violation :red:
Also it seems he forgot to modify the "All Rights Reserved. Copyright ยฉ Mytho Lifeโ„ข, 2002, 2003." line on the bottom of the page. Maybe that's useful :D

Hah! Look at JailMail! Hilarious, but I don't think it's supposed to be.
Anyhow, just my .02, but being at the same IP doesn't mean it's him... but if it is him, go back and remove the hyperlinks from your original post so as not to give him a bunch of backlinks ;)

Brilliant detective work guys...thank you very much.

In reviewing the list of other sites posted in this thread, it turns out that breast-feeding.us is an exact copy of the content of a site owned by a good friend of mine (compare to www.cerean.net , my friends site, it's a direct rip-off of content too) and that radarmadness.info is a copy of a site recently offered for sale on DNF (which is radarmadness.com).

This guy is very blatant and I, usually being a very easy going person, am very uneasy about this and want to stop this guy. A lot of time went into developing this content for all it's authors and not only is this guy ripping off these sites, but he could be drowning mine and other's google rankings with redundant content problems.

I thank you all again for your dilligent work on this and please feel welcome to post further insights...I REALLY do appreciate them. I have emailed this person and given him a firm understanding of how I plan to proceed in this matter and I will absolutely be dilligent in protecting my content. Hopefully he'll just stop what he's doing, but I won't bet on it.

All the whois do seem to be the same guy.

Yes, I didn't mean to place the hyperlinks. I just pasted and bbcode took over adding them. Should have verified my post before moving on. Anyway,it's fixed now.

Another remedy you might look into is having his domains taken away for false whois info. I'd contact the registrar and cc. to ICANN. He must know he's doing wrong by having fake phone numbers and other bad whois info to cover his tracks.

It won't be surprising if it turns out some of those domains were obtained
using stolen credit cards.

For those who have original content to protect, a nice little tool to find Web sites and even pdfs where your content has been copied is www.copyscape.com. It's not perfect, but it finds a lot.

What I would do RIGHT NOW...

Print out every page of your site making sure that all of the pages have the date on them. I would also put a copy of the website on disk. Use the original FrontPage or Dreamweaver (or whatever editor you used) files which have the "created on" time stamped to the file. Then, I would take all of those and put them in an envelope with your address as both the return and "ship to" address. NEVER OPEN THE PACKAGE one it is delivered to you. Simply put it away for that rainy day when you might have to go to court. It may help to prove you were the first to create and go live with that exact site. At any rate, it is just a good thing to do. Postage won;t cost you much, however, that depends on how many pages you've got.

I would also copy his pages spo that you can prove he was using your footer with the copyright info.

As well, I think it would be a good thing to make copies of those other sites he has stolen.

Anyway...

I would send him a letter in the mail if his whois info is not private. If it is private then you might be able to get the address from the company that offers the privacy service to this person. In your letter, be brief, forceful, and to the point. Almost as if you are a lawyer sending a Cease & Desist letter.

I would also report him to his host like others have mentioned making sure that they understand that when the lawsuit is filed, the too will be sued as the content is residing on their servers. this should get them to act in your favor quicker, but do not come accross as rude as they may take offense and (if they are a big company) may not even listen to you pleas/demands.

That means nothing. All hosting packages that you see advertised everywhere that are affordable to the common man is SHARED hosting. You share your server with others, Therefore, you all have the same IP address unless you request a dedicated IP (which you would need of you wanted an SSL cetificate for your site) or pay for dedicated hosting which means you have your own server and therefore no one will have the same IP address as your site.

If all of the suggestions in this thread fail to produce the desired results, you will need to get a lawyer to send him an official Cease & Desist letter and if that does not work (but it probably will) then you have to file suit against him.

Like others have said, you should report him to his host, ICANN, and his domain reg for using false whois info (if in fact this is the case). If it is true he is using false info on his whois, I would report him regardless if he takes his content down today or not. Why give this guy any slack, he is a slimebucket and looking to profit off of your hard work!!!

I would contact Google about the violation. Let them know that the original content is yours. I'll bet they'll be willing to work with you.

That is some good advice and I hope it works out for you zesty and also that is a useful site fundraiser but it doesnt work too good since I searched my site http://www.explosive-hosting.com and it showed me alot of hosting websites like mine but it only looks for text.
