Multiple Trademark For a Single Domain name!

Hello,

There are Domain names that are Trademarked by Multiple Companies, say EAT(dot)COM, If we check this name with Trademarkia we can see multiple Trademarks ..Suppose i got EAT(dot)com, now can i list this Domain name for sale?..I have seen Domain names like POWR(dot)com with multiple trademarks is listed at BrandBucket(dot)com for 30K or something, kindly share your thoughts..

A trademark can be taken out with Worldwide registration, or it can be Trademarked in separate countries. This is perhaps why you have seen multiple trademarks. They will be in the countries of the owners.

There are few companies that trademarked "EAT"

For example,

"This is a brand page for the EAT trademark by EATRAVEL, LLC

This is a brand page for the EAT trademark by MOGO ASBURY PARK, LLC"

If i own eat(dot)com without trademarking the name. So who can File UDRP in this case??...

Better yet, stay away from domains that can have TM issues.

Anybody with an EAT trademark can file a UDRP if they have a domain with the word EAT in it and you are infringing on their trademark. They can file a UDRP against you even if they don't have a trademark and you aren't infringing (but success might be questionable) .

I would file a trademark for my domain if it had multiple trademarks worldwide.

Someone will want the domain! so better to protect it.

It increases the value of domain also.

You can list a domain for sale with multiple trademarks just so long as you are careful not to infringe any of those trademarks. But that won't mean that multiple trademark owners won't file UDRP's against you. They might.
