Hi Echo,

What exactly does this mean in practice? What are the consequences?
Hello,

An unacceptable business practices infraction is one of the highest negative point infractions on NamePros. Each account is allotted the same undisclosed number of points before it automatically closes or becomes restricted.

Since it was the members first infraction, their account was not restricted or closed.

However, if the member fails to honor a second binding agreement, their account will be restricted from the marketplace for security reasons for a minimum of 6 months.

Each case is different and in more serious incidents, an account may be restricted immediately due to security or safety concerns.

However, this was not one of those cases. This was more of a "seller realized their asset was going to sell for less than they wanted, so they tried to change the terms of the sale to avoid having to sell it" case, which is deemed an unacceptable business practice.

Note: Infractions remain on an account indefinitely, even after they automatically expire and are used in future investigations to determine habitual patterns and intent. This assists moderators in keeping the community safer and more secure.

We hope that information helps.

No Winners here then. It's easy to see both sides. Maybe there should be some sort of 'Accepting term and conditions' interim stage for posting selling or auction posts.

Allowing the input of a later reserve price is clearly against the spirit of an auction. So in this case the auction should be invalidated imo. OP restricted from further sales 2-3 months - Nobody happy but some sort of justice served.

The thing that doesn’t make sense is that you CAN add a buy it now mid auction. In this case the seller could’ve just set $500 as the buy it now and not received an infraction.

If the system was really fair you wouldn’t be able to edit an auction thread once it’s created.

I think when you feel personally compromised by the Mods action. You can make a decision to walk away from the Forum. I went a bit over the top and requested my account closed as BaileyUK Hence now Revisiting. But I was pleased to give it all a rest.

The issue was already resolved here:
Hello,

We can see that @Alfa Mod Team posted in the sales listing today at 6:10pm CT with a rule reminder, however, the very first report we can find regarding the matter was today at 1:54pm CT. So their response time was roughly 4 hours from the time of the report, not over a week.

Keep in mind, with hundreds of posts daily and multiple higher priority tasks moderators deal with on a daily bases, moderators mostly rely on members to report rule violations when they see them so we can be made aware of them, investigate and get more involved.

If a report doesn't happen, chances are, a moderator hasn't seen the violation.

After reviewing the auction for a second opinion, to be sure, we can see that @Alfa Mod Team posted the correct winner.

The seller attempted to add a Reserve price after a binding bid was placed, in addition to reserve prices not being allowed.

The end time was 120 hours after the last bid. The last bid was by member @mdent

Reserve prices have never been allowed on NamePros and the rules are clear regarding trying to change the guidelines after a bid has been placed.

The auction was not voided because the reserve price was not present prior to the first bid. The seller added it later, after bids were placed. The seller is bound to honor their original auction agreement at the time of the first bid being placed.

Rule references:
6.2.2. Reserve prices for auctions are not permitted; auction holders (sellers) must set a starting bid that they are prepared to accept.

6.2.3. An auction cannot be modified once a bid is placed with the exceptions of its Buy-It-Now ("BIN") price (e.g., a BIN price may be added), its bid increments, approving additional bidders, adding payment methods, and/or adding additional domains at no extra cost. Once a bid is placed, every allowable change (the exceptions just mentioned) must be posted to the thread as a new reply as well as updated in the original post before it becomes effective and valid (e.g., a BIN price cannot be accepted until that is done, but rule 6.2.10 applies). BIN prices are not reserve prices and therefore do not affect rule 6.2.10.

It seems that members didn't know all the details before creating this thread and commenting.

We hope that helps clarify a bit more.

In the future, please use the report link on a post that violates the rules as soon as you see it so a moderator team can investigate and get more involved.

Since this matter was based on false/inaccurate information geared to harass moderators and has already been publicly resolved, we are closing the thread.

Please review the resolution posts in this thread for more information.
