You might want to check Digg's Ts&Cs but you're not allowed to resell / make profit based on the listings of the service (which don't belong to Digg anyway and are copyrighted by Kotaku.com in your case!!)

if you think the domain is worth your BIN list it like a simple domain.

The site no longer pulls from digg.com, as mentioned in the update. Also maroulis please do not trash this thread, I've checked the Digg.com T&S personally and there is no mention of it not allowing sale of sites using its feed. You might want to check it yourself. Nor am I infringing upon the rights of Kotaku.com either since every link/image links back to Kotaku.com and i've used their ad supported xml feed. I have not copied nor taken credit for any of their work. Feedburner.com uses the same idea, takes RSS feeds and parses them.
