So heres the situation, I have a dot com domain name and I am trying to sell it to an end user. They have the dot net and dot org. So theres no reason why they wouldnt want the dot com. The problem is, the whole site is in Arabic. The email however is in english. I contacted them, but no respond.

What you guys think?

If you approached them first, they can probably legally take the name.

Well they cant legally take it if its not TM. Which it isnt by the way

Which TM Registries have you searched? Have you searched the Registry related to the arab country of the website... if there is such a thing?

I think they can't read english.

and did they register the .net and .org before you did.....if they've held them for sometime without getting the .com or let the .com drop then its going to be a very hard sell......As been said before if they havent responded they probably are not interested, most people, even if they cant speak the same language can find out what something says...if someone sent me an email in arabic I have ways of getting it translated

Most people just type it in Google and use Google translate....simple

Well I picked up the .com when it expired. I didnt register it myself. So they might not have gotten the .com because it was never available

A domain need not be registered at the USPTO to be a TM. TMs are also established and valid by use.

Are all three domains registered by US-based registrars?

Since when has that had anything to do with it. Ive seen plenty of people do the same thing. If it isnt officially trademarked, then they are tough out of luck. Plus its a blog site, nothing much really worth trade marking

No matter the disposition of the domains question, you might try spending a few minutes in the legal section learning about TMs for the future.

Unfortunately the arguement "Ive seen plenty of people do the same thing" doesnt work when dealing with legal matters, Ive seen plenty of people speeding but when I get stopped do you think the cop / policeman (dependant on where your from) will accept that.

Did you try both the WhoIs contact and the site contact?

this was your first and biggest mistake


assumption


instead of thinking of why they "would want" the domain, think of why they wouldn't.

could be price or other factors


second mistake, contacting them with solicitation to purchase


if you have no legitimate use, other than to upsell


which establishes "intent", then it could put you in a defensive position later.


if you waited to see if they would contact you first


then your position is different and leverage is greater


i get emails from youz guys and gals, saying you got the com and since i got the org or net....then i must be interested.

i'm really not :)

Yeah I guess you guys are right. But then why have the .net and .org?!?! Thats somewhat useless in my opinion. Everyone knows .com is far better and cheaper!!

Arabic countries/users are comfortable with .net if it means not having to spend extra $$$. Of course, there are exceptions... specifically when they are domainers.

If it's just a blog, I think they are happy with .net and .org. If the blog is about some non-commercial issues, then .org is better than .com. You must also not forget that .net is more popular in the Middle East compared to the rest of the world.
