Hi all,
One of the biggest hurdles to content aggregation is the proper use and acquisition of video material. This is one of my greatest concerns as we move forward with WineCountry.TV. We want to have full rights to braodcast aggregated video on our internet platform and possible repackage said content for use on other broadcast channels, i.e., cable TV, satellite TV, etc.
Without certain rights we could open ourselves up to lawsuits and I forsee a time when current aggregators who claim fair use and public domain use of video are going to have original owners come outta the wood work and start suing for their fair share.
I have asked around a fair bit about licensing agreements and who is using what format and haven't had much feedback. Called a local IP attorney today and explained our simple needs, with attornies there is no such thing as simple. So went over to NOLO.com and picked up "Getting Permission: Licensing Copyrighted Materials" which also comes with a couple dozen standard forms to customize to your needs. At $27 it was well worth it. With our logo now complete and licensing agreement in hand we will proceed with aggregation by the end of this week. You will be able to see our progress on the site as we continue to add videos.
I would reccomend everyone who is developing a video site using other people's video creatives to get permission for every piece you use.
Crap is certain to hit the fan if you are super successful with your site.
