I will make this quick.

I have (Name removed) and have had it for years. Someone registered the .net and now have a business up on it.

I have for the first time parked some domains. I used Sedo. I have some for over a week and for the most part they were getting what I assume would be OK unique hits. On Friday I put up the above mentioned .com and it has now surpassed my next best domain which had a weeks lead.

Now what can I do? Can I approach the company that has the .net and ask them if they would like to purchase the .com? Will this open me up to legal action? Should I stop parking it? I have no idea what is the best way to proceed.

Any advice from the big dogs? :-/

Short answer, it can cause problems if they can demonstrate trademark rights
to the term.

Ok ask yourself...why have you parked it just now, after finding out...and why are you surprised that it gets traffic...they have a business with that name?...regardless of you have this domain registered before they had the .net....UNPARK IT!!!...it could hurt you in the long run because you are showing bad faith now.......my 2cent.....

Yes, unpark the domain. If it can be proven you road their TM for commercial gain, that could hurt you. As far as approaching them, make darn sure they were not in existance before you registered the domain. But always tread lightly.

Thanks Everyone! I unparked it.

The reason I parked it was to see if and what kind of traffic I would get. I am new to parking and I parked 3 domains a little over a week ago. I got some hits so now I am looking at other domains I own. I will not contact them.

As always I appreciate the advice. :tu:

Edit your post and remove the domain name. That's my first advice.

Next...unpark and develop if possible...but that's ALWAYS my advice to domainers.

But if I develop could I not run into the same problems?

Only if you compete with them, if the term is a trademarkable one. If it is a generic term, well it would be best to dev it in a different direction than them any way you look at it.

You can if the term turns out to be used in commerce by more than one guy.
Unfortunately various decisions have essentially placed the burden on us to
ensure how we use those domain names don't infringe someone's IP rights.
