Is "live" TM?

Hi, i was going to reg some ****live, but wanted to be sure that "live" was not TM.

I looked in WIPO and USPTO, there were around 500 results with the word "live" in them, so didnt want to look in to them all.

So to see if there had been any TM issue before with domains, I searched in "Domain Name Dispute Resolution Center" at WIPO.

There were some results, but not directed at the word "live" more the word next to "live".

There were two results involving "live" I could not figure out, so I hope NP-members will help me understand them:

marketlive.com (was terminated... why?)
http://www.wipo.int/amc/en/domains/search/case.jsp?case_id=3017

livestats.com (was also terminated... again why?)
http://www.wipo.int/amc/en/domains/search/case.jsp?case_id=4751

These two domains was terminated, although I think they are all generic words, why were they?

So I am unsure if I should reg. ****live.com's

If you look through the TM some short of popular words have hundreds of trademarks. It comes down to intent in virtually all situations.

MicrosoftLive.com = Problem

ConcertsLive.com = No Problem

The ones I want to reg. is 100% generic, no company names.

Some people are too obsessed with TM issues. While I always take it into consideration before doing anything. It still generally takes using a domain in bad faith to be a problem.

I honestly don't see any problem if you don't include the name Microsoft in any part of the domain name like bmugford said earlier.

But my question about the two domains I mentioned in my first post, still stands. Why did they got terminated?

marketlive.com is now the homepage for an e-Commerce Software.

livestats.com redirects to Microsoft Advertise site.

But why did they terminate in the first place?

No, it should not be. Its a generic word.....at least I think!

Some people thought that...only to find out the hard way it can be wrong.

Shell and Tide are generic. But aren't they also trademarks?

Only the 2 parties involved knows the answer. Usually, the complainant and respondant work things out. Maybe the respondant gave in, maybe the complainant paid some money.

As far as "live" depends on usage. MS has several "live" TMs which if you decide to venture, MS could have something to say. But each situation is different and is based on its own merits.

As others have stated, its probably going to come down to usage and how hard you are willing to fight for a domain. As long as there are no active tm's, and you don't find any services or products being marketed under the same name (and you don't use it the same as them), you are MOST likely ok. Not necessarily but I would expect your chances to be good of being ok.

Thanks for your input. I have listened to your replies and regged a couple I liked.

I think I have done what I can, to investigate and make sure I am not doing anything against any TM, so I have now a clean and good concience about regging them.
