Hyphenated vs non-hyphenated?

I've developed a social site using some nice keywords such as keyword1-keyword2.com

So it's working(good) but some company owns keywords1keyword2.com but it is undeveloped. After some checking i found they specialize in social type sites (bad.)

How do think i can protect myself? Apply for the TM in the USA? Obviously it will cause confusing if they set up the same site. I also own worldkeyword1keyword2.com, i was thinking to switch over there but the first choice is better with the hypen.:music:

It makes no difference what domain they have or if it is / isn't developed.

Has this company been using keywords1keyword2 for an existing product or service? Have they filed for a tm on it? Are keyword1keyword2 generic or descriptive of what they/you are doing?

If they haven't used the phrase or shown intent to use, you may have first use in commerce which would give you an advantage. If it's generic or descriptive, neither of you can file a formal tm.

When in doubt, ask a real lawyer - especially if you're sinking time and money into developing this site!

no it's a social site, the other company has a bunch of social sites and domain with white label dating service. But the domain i want has nothing on it now. I wonder what i can do if that changes? propably nothing. which makes me wonder if i should develop worldkeyword1keyword2.com or THEkeyword1keyword2.com at least he would get my mistypes traffic?
