Sometimes, we wake up and realize that a portion of domains in our portfolios have been potentially devalued. For the CBD and Vape domain investors, this may or may not be a possibility if the ban starts to extend and spread into other states, regions and countries.

On June 20, 2025, Governor Greg Abbott signed Senate Bill 2024 into law, which took effect on September 1, 2025. This statute broadly prohibits the sale, marketing, and distribution of any vape or e-cigarette product containing cannabinoids derived from hemp, explicitly including delta-8 and full-spectrum CBD vape cartridges, even though possession remains legal. Violations are treated as a Class A misdemeanor, punishable by up to one year in jail and fines up to $4,000 per offense.

The ban also extends to vape hardware and consumables:
  • All vape juices containing delta-8, delta-9, delta-10, HHC, or other hemp-derived cannabinoids.
  • Disallowing flavored or novelty packaging designed to appeal to minors,
  • Banning devices “wholly or partially manufactured in or marketed as being manufactured in” China or U.S.-designated foreign adversary countries.

So should we expect cheap and dropping Texas CBD domains? The bans are not forever and experienced domainers are patient, or at least should be. ;)

There might be drops from Texas based investors, but most may pivot to liquidate with other state investors that the products are still legal in.

This is a red state sweep, which probably won't effect blue states, but there's the possibility other red states may follow suit. Resulting in a domino effect.

Time will tell if this will be a one off. But normally, red states following suit, just like blue states follow suit with one another.

It may be months or years till the next ban hammer swings or a red state may go through an election and change to blue, which would block a ban like that or erradicate an existing ban and re-legalize it.

It's all speculation at this point, as to what the future holds for the cbd/vape niche , if it's an isolated event or a domino effect starting.
