How do I ensure I will get the actual code if I pay developer?

I have decided to stop the project with this offshore Indian developer.

I want to pay for the code up to the contracted time (5 day billing period).

However I do not trust them as they are unethical.
They have made a bunch of promises but have never delivered eg promised to upload files to my server after every billing period (5 days) but never done so. So this is the end of the 2nd week.

Also the developer has blatantly inflated his timesheet (I have seen it) eg. taken 8 days to complete a SIMPLE HTML form that was already 50% done!
Plus 0.5 hr each time to change the typo within a tag, 0.5 hr to change page title!
These are not just isolated incident buts MANY ex of timesheet inflation to rack up billing hrs..
Currrently the code is uploaded to their development server so I can see how it functions.

The only idea I get is to pay him 50% of the money, and the promise to pay him the rest after you get the code.
And dude, stop working with this type of people...if you see something strange, just walk away

Yes, if you feel something fishy don't hesitate to let your developer know the issue.

I always ask my clients how can i improve my service to them, if they find anything undesirable I like it better if they let me know so to save time & money on both sides.

Sounds like relation gone bad.
I doubt you'll get the codes easily.

How about ask them to send you codes first and then, you'll pay?
I am guessing chances are that they'll say no.

If you pay first, what can you do if they don't send you anything?
Not much.

Perhaps it's better off forget about whole thing?
If you still want it, you may want to consider using escrow service.

I heard too many such horror stories.
Outsourcing to third countries are good, but, be very careful.
I outsourced many times to India, China and Ukraine.
I never had a problem except minor communication issue.

So, how come I never had any problem with outsourcing?
Don't hire cheapest. Don't hire strangers.
I always hired someone by referrals.
If you can't find one by referral, hire one with lots of
100% positive Trader Ratings.
