If I registered a historical figure's name and don't plan to monetize the site, but instead share a part of history that isn't too flattering to the historical figures conventionally recognized history, would his descendants have any claim to the domain? Do I have any recourse in a situation like this?

Depends on the figure, but if most of the stuff ya say is positive they'll probably be happy to see it.

Yea well thats the problem. I have no intention of casting a positive light on said figure. I care not for manifest destiny and would rather detail historical truth.

You would be fine it's fair use to use it to state your facts I really don't see there being an issue

Thanks for the heads up. I was ignorant of 'fair use' (and intellectual property in general). For anybody interested, this link helped to explain the premise of fair use. -

"Fair use" doesnt just allow you to state "your facts" unless you have enough proof to back up those facts. There are issues to do with slander and putting a family name into disrepute that could come up.

Well I guess thats subjective now isn't it? Your perception and interpretation may vary from mine. Semantics. What constitutes 'enough proof?' Does constantly referencing different sources constitute enough proof?

Well how i see it is that you won't have aproblem with that because you have all the right to put w/e you want in your website "NOT COPYRIGHTED"even if the decendants want the website.

Include a disclaimer that your site isn't the official one and what users will see
are based on what you've gathered.

Of course, nothing will stop the figure's descendants from suing you under any
and all laws applicable, and a disclaimer isn't 100% foolproof. But sometimes,
every bit helps.

How historical a figure we talking here? And I gather it's not Benedict Arnold? :D

Lorrin Thurston and Sanford Dole. If you're familiar with Hawaiian history, you'll recognize these names as the main conspirators along with the US for the Hawaiian Monarchy overthrow.

as long as the site is based on facts there is nobody who can say anything to bring you down.

In a sense that i'm questioning conventional wisdom, I guess I am. I am in no way advocating socialism though ;p
