"Good name" is TM but can I register "goodname"?

Firstly I would like it if someone could give me the url to search tradmarks, I did have it bookmarked but can't find it :(

Now I know that a name is trademarked, the name for example is "Good Name" now there is a space between them making it two words, this particular name is often said as one word, although it is not in the dictionary as one word. So my question is can I register the .mobi of "goodword".

Sorry (newbie here) I don't understand your questions really, but in regards to is the TM active, I would assume yes as they are an active well known company who use the name for their company name.

space or no space, all you need to do is ask yourself.. is the name similiar or confusingly similar to the TM? The answer would be yes.

The company in question has a company name that is "generic" for example it can be used to describe the company in question or it can be used to describe something else, for example: "greyhound" I do beleive is trademarked, ok so I can't have "greyhound" but can I have "grey hound" with the purpose of develping a site about grey hounds?

It does sound the same so yeah LOL what do I do just forget about it :hehe:

It depends entirely on the usage... if you plan to use it for something that could in no way be construed as competitive to their business, or cause confusion, then most likely yes, you could use it. www.uspto.gov (to search for trademarks). Do a search, see what category of goods or services they have the name trademarked for, and if you provide something completely unrelated, you should be fine. You still may run into problems, but technically speaking, they would have no rights.

Good deal thanks for the advice, I think I will register the name and get back to you here with the domain so you guys can tell me off or praise my actions :hehe:

Comments given in the legal section shouldn't be treated as "advice". Only a
qualified attorney (especially if retained) can give you that.

Shorthand answer to your question is yes. But the real question is will you be
able to hold on to it for a long time, especially if how the domain name will be
used possibly infringes the other party's trademark rights.

If the domain name is PaintShops.mobi, would that still be considered as trademark infringement?

That can be, yes. But will it be depends on various factors (e.g. usage).

Believe it or not, I also agree with that to a certain extent.

And never let the lack of simple research be your downfall...

AS with anyhting, usage would play a huge part. If you offer anything in the graphics or software field, then you would be violating the TM.

"Never let a trademark keep you from registering a good name."

And if you use that name in bad faith, you could lose it.
