Give up Cybersquatting ?

The three elements needed to prove your UDRP case are :-

1) Is the disputed domain confusingly similar to yours

2) Does the registrant have a legitimate interest in the name

3) Has the disputed domain been used in bad faith.

Hope this is helpful, try for a refund.

You won't get more earnings from this - most people will correct their mistake without clicking on your ads.

Grace delete - besides leaving yourself open to a lawsuit, cybersquatting is lame and makes the entire domaining industry look bad.

Under the ACPA ( Anticybersquatting Consumer protection Act )
it is possible to be sued for between $1000 - $100000 per offending domain name.

Depends whether they want to make an example of you.

Take a look at the World Intellectual Property Organisation (WIPO) website.
No-one is above the law, no matter what your location is.

What you should consider is your integrity. Would you rather be known as a domainer or a cybersquatter ?

Just out of curiosity, has anyone heard of any examples of anyone being sued by a say American company, when they were living elsewhere in the world?

I believe i read somewhere on here that it is somewhat more difficult for say an American company to go after a Canadian Domainer.

Domainer / legitimate domain developer >>> Cybersquatter / leech

If you live in Nepal allow me to do a little guessing that you have no money, or that is the impression you give?

Facebook lives in California, with more money floating around than most here will ever see combined.

If they wished to make life difficult for you then they could, even going so far as to bankrupt you which is very bad, when this happens it means that no banks will touch you...

Get rid of it, or at least take it offline, there is no way claiming you don't know it is illegal will save you in a legal dispute.

facebook is a generic term and has been used way before the website facebook became famous. Only becuase they have a trademark in the USA and possibly in some other countries might not make it illegal in Nepal or other countries.

Snicksnack, a generic term can become a trademark if it is associated with a certain thing by legacy.

Apple, has absolutely bloody nothing to do with fruit but no one in their right mind would dare to take the name.

Marathon bars, before some idiot the changed their name to snickers for completely unfathomable reason...Marathon is a generic term but using the name for cocoa is bad. (was bad)

Facebook has become such a leviathan that its very name makes people recognise exactly what it is, therefore it is not simply a generic term anymore.

The same reason I would never register googol.com if it became available, googol is a generic word meaning a f**king big number, and by your definition free game, but now Google are so well known for it...

Ask someone like Jberry anyway in the legal forum, he would be able to explain it far better than I could. but I will paraphrase, taking names that were once generic is bad news if those names subsequently become big.

I know that generic terms have been trademarked, but doesn't mean the trademarks would hold up in all chases and are recognized in every country.

cheatcodes.com went after cheatcode.com (owned by Frank Schilling). Frank directly filed to get their trademark removed. Now the company seemed to have backed down and Frank can keep his domain.

and that's probably because Frank payed his lawyers a friggin load of money and had better lawyers/arguments....(i don't know the detail though)

:)

.........,due to the potential of infringement of a famous mark Sedo must do the following:

- Suspend the domain name from our domain marketplace

Now should i delete those two domains which gets a very resonable traffic or should i develp a mini site with a diffrent catagory?

Delete them, you are on facebooks radar right now so why would you still be asking? :-/

I suggest that you just delete them.

You may still be able to get some refund if the domain registrar has grace delete phase.
