Expiring company names...

was looking to expiring domain names a few days back...hit upon an idea ..but i dont know how much legal this is...

one domain i was looking and was impressed was...www.BDMtech.com

it was short...brandable....and when i check with google and yahoo and net archives...all had results....google had nearly 30 pages cached...yahoo more than 50...and net archives showed data for 3 yrs...

i even managed to get the contact details of the previous owner of the site..via data mining and google...

now the thing i want to know is assuming:

i backorder and get this domain. will it be legal to contact the previosu owner and offer it for sale back to him..not for a big amount...backordering in pool costs 60usd...i will charge 275 usd...which means 200 usd profit for me easily...

is this legal...or will any problems come from the legal front...

if this works out..i can easily sell atleast one domain per week to the old owners... :hehe:

This is done by other domainers as well. Keep in mind that old owners may not really be interested. As a matter of fact it may be 10 domains before you find 1 that the old owner really wants back. The problem is that if the old owner really does want it back...he may feel you are extorting him, which you are, are fight you for it instead. Of course having the domain priced reasonable is a good idea.

My advice...only backorder domains which you feel have value WITHOUT selling them to the previous owner. This way if you are turned down you are not wasting money.

thanx a lot for those kind words...

some of the reason why i am pricing it reasonable is..

• If the rate is at a higher rate, the person will not care to buy it but where if its in the lower range of 200 to 300, I believe someone will surely buy it
• I already have a target person to sell this domain. So i need not charge very high, which will obviously scare him off.

Another trick i am thinking off is to find a suitable domain which will expire 3 days from today. Then contact the prev. owner today itself saying that I am about to buy the domain which was previously his. will he be interested in getting the domain from me etc...So i have 2 days to decide whether to backorder it or not.

i dont know whether this will work or not. So I already put into action this plan and have contacted an owner reg. an exp. domain. waiting for his reply. the domain will expire in another 2 days.

its certainly legal but might not be too ethical (from some people's point of view) . . .

A lot of people are doing this already so be careful that a lot of these domains will get bid up and no one ended up wanting it back . . .

make sure to have a backup plan to develop the website instead too

Intent to register a domain (albiet, backordering an expired name) with the intent of selling it to a TM holder (or possible TM holder) is the very definition of cybersquatting.

I see where you are going with this, but regardless why the name was dropped, it would still come under the same rules as squatting. And just because a domain was released does not mean that the TM is no longer valid. So it could go either way, the company could be greatful (they may have had a glitch which is way it was not renewed) or could be vengeful (they think you are trying to screw them).

Just proceed with caution...
