Okay, it is time for me now to clarify some things.
As someone said, this .eu is already becoming a BIG scam.

I guess i was one of the first to wonder, how people can have TM on Sex, Travel or Hotels?
Actually, nobody owns such Trademarks. I said NOBODY.
You'll ask then how this is possible to have more than 220 potential registrants on sex.eu ?
This was the game of the registrars.
I got Eurid representant today on phone. As many of us, i "reserved" several common names to my legal registrar (Indom.com). But as long as it was requested to have TM's to be eligible for the Sunrise I, i didn't hurry too much to pay more than 200€ per name to be in a priority list. I just thought, maybe time to wait Sunrise II.
What a big mistake!!!
In fact, we already know the owner of all these precious domain names.
Who are they?
Simply those at the top of each list!
Why?
Because until 16th of january, Eurid will waiting to receive official documents, like TM, to determine the new owner of each name. As said, nobody has trademark on Sex or Travel or Hotel.... So the list will remain like this and Sunrise II will begin. New potential registrants will apply... Like those who have a particular interrest into Sex.eu or Travel.eu. But as long as nobody will have the legal documents to proove that they MUST own sex.eu, the list will remain until 7th April. Public release. As it was stated everywhere, the rule "First come, First served" will apply. But into the list of already recorded registrants! Which is meaning, the first one already listed will get the name by default.... from the others to present legal documents....
I had it really bad to hear this.
What i got harder in the face was:
"Only the registration fee, which is, i guess, €25 will be refunded. The €200 won't."
Ahahahahah, just make me laugh... go ahead guys, it will be really creative to have .eu market only composed of "Domain name for sale" websites :D
What make me more laugh is, Netherland and France, who both rejected the EU consititution, are the first countries to invest into this market :D

I don't know about in European countries (although I suspect you will find that many generics you list indeed have trademarks in one or even several European countries) but in the US there certainly are registered trademarks on terms like "sex". One is for selling refrigerator magnates (and appears to have been registered by a domainer for obvious reasons). All that a qualified EU domain registrant needs is to provide proof that a government has granted a trademark to them for the term. This is different than debating whether a trademark holder could take a generic domain from a registrant. It is not a question of if someone else has a right to use a term or even if another person also has a trademark, it only has to do with a technical matter of the person in line in the que having a registered trademark somewhere. Generic words can easily be trademarks as long as the term is distinctive for the product or service it represents.

I understand what you are saying about the list remaining "if" a trademark is not proved which would be very unfair, but I suspect most if not all the generics with multiple applicants will end up with someone who owns a trademark, no matter how obscure the registration may seem.

yea their are going to be alot of disputes abaout tm issues with these .eu domains

What have always knowng the EU has had problems... Sorry for the political joke, but it seems somewhat strange the registrars didn't have all of these problems sorted out before the .eu went live for sale. I'm just surprised snapnames couldn't get their hands on all of the .eu domains and auction them off. Who knows what a1.eu could have gone for....

No there wont, because all who have applied will either have a right to a name or not.

They go through the list using the "First Come, First Served" practise, and pick the one down that line which first meets the registry demand for RIGHTS to the domain.

The person that got there first with the nessercary documentation which proves that they have a RIGHT to a domain, gets the name! That's the whole point in the Sunrise Periods.

Because of this, companies cannot argue their way into getting the domain. Therefore no TM issues.

Sorry to contradict you but Eurid will only record files and absolutly not authenticate them.
I already found a registrant who seems to have Trademarks on Sex, Hotel and Travel ??!!!

maybe we should blame mickey mouse at the international trademark office too... since the trademarks are valid according to the gov't

What are you talking about? Internationnal trademark office ? Never heard of it before. At least, don't forget that all countries have their own trademark offices and many of them are not so precautionnous in the way to deliver Trademark letters. (Eg: Romania or Malta...).
At last, since this year, EU is also counting with many old eastern republics that are much looking on the money than the proof of ownership to deliver legal documents.

You know, i can also buy a Doctor diploma on internet, which is not meaning i will be a real doctor.
